NOTICE OF DUES RENEWAL
This Membership Agreement (this 'Agreement') will renew automatically on a month-to-month basis at the end of the initial term referred to above, with monthly dues to be paid in the amount equal to the dues in effect at that date. True Power reserves the right to change the amount of dues and charges payable hereunder at any time after the end of the initial term referred to above. Member may cancel this Agreement at any time after the initial term referred to above, by written notice to True Power. Cancellation shall be effective on the next monthly dues payment date; provided, that any such notice of cancellation that is not received by True Power at least 30 days prior to such next monthly dues, payment shall be effective on the next succeeding monthly dues payment date.

ANNUAL MAINTENANCE FEE
In order to maintain club equipment and facilities, I authorize East Highlands Fitness (EHF) to initiate a charge of $10 for annual maintenance on or around May 1st of each year of my membership.

TERMS AND CONDITIONS

A Term Membership will expire at the end of the term purchased. Memberships are non-transferrable and non-refundable. If you have purchased a recurring billed membership, your account used at sign-up will be billed for a minimum of 12 months and will continue on a month to month basis at the monthly rate at sign-up until you cancel in accordance with this agreement. Your monthly Membership Fee is guaranteed for as long as you remain a member in good standing including payment of all monthly dues. To cancel your monthly recurring membership after the initial 12 month period and stop any future billing, you are required to submit written notification 15 days prior to your next billing date. Notification must be delivered to the facility in person or via certified mail to the address at the top of this agreement. Any fee received prior to cancellation submittal is fully earned when received and is non-refundable. As a member who provided a credit card for billing it is your responsibility to inform the facility of any changes to the credit card such as expiration dates. A $10 service fee will be applied for each month your Monthly Recurring Membership Fee is returned uncollected for reasons including, but not limited to, insufficient funds, expired credit cards, cancelled credit cards, overdrafts and closed accounts. Recurring billed memberships may be frozen for one continuous 30 day period once per calendar year. During that 30 day period, membership to the gym will be suspended and any billing scheduled during that period will be stopped. No membership, whether term or recurring, can be extended unless for medical reasons at which time a doctor`s note with the dates stating when the member was unable to work out must be presented to the gym. Provincetown Gym reserves the right to cancel any membership at any time if member displays offensive, inappropriate, disrespectful or abusive behavior towards another member or employee of the gym. I understand and agree that photography and/or videography of any sort is not permitted on the premises without the prior written consent of Provincetown Gym management and is a cause for termination of membership. By signing this agreement you declare that you have read, understand and accept the terms and policies stated above.

WAIVER AND RELEASE
I understand that I am entering into a contract with the business entity known as The Provincetown Gym and Fitness Center located at 81 Shank Painter Road, Provincetown, MA 02657. This contract allows members access to the facility and use of all equipment during posted business hours. I understand and expressly agree that my use of the facility involves the risk of injury to me whether caused by me or not. I understand that these risks can range from minor injuries to major injuries including death. In consideration of my participating in the activities and use of the facilities offed, I understand and voluntarily accept the risk. I understand that equipment and facilities available to use may require specific instruction for proper use. Provincetown Gym is not liable for any personal property that is damaged, lost or stolen while on or around the premises including, but not limited to, a vehicle, bike or it`s contents or any property left in a locker. If member causes any damage to the facility, they are liable to the Provincetown Gym for it`s cost of repair or replacement. The owners and all employees and subcontractors of the facility shall not be held liable for any claims, demands, injuries, damages, actions or causes of action whatsoever to the member or their personal property arising out of use of the services or facilities on the premises at 81 Shank Painter Road. I hereby forever release and discharge the Provincetown Gym and Fitness center and respective agents, employees and contracted laborers from all such claims, demands, injuries, damages or causes of action. All memberships are non-refundable and non-transferable. Memberships may not be frozen or extended except for medical reasons at which time a letter from a physician must be presented which includes the dates the member was unable to attend the facility. I understand that sun tanning equipment can be deemed dangerous and I accept full responsibility for use of said equipment. I agree to read, follow and comply with all instructions located on the exterior of the tanning unit specifying the use, suggested tanning times and contradictory medications associated with ultraviolet tanning equipment. I agree to wear required eye protection. I am fully aware of the risk associated with ultraviolet tanning and waive any rights I may have from the misuse of the tanning device and am using said equipment at my own risk. By signing this agreement, I acknowledge that I have read and fully understand the above waiver of liability and enter into it voluntarily.
