Member is responsible for canceling membership. To cancel membership, member must notify 1st Place Fitness Center, with a 15-day notice, via email to [email protected], voicemail on gym phone number (256-943-1129) or directly contacting 1st Place Fitness Center staff member. If cancellation is requested within 15 days of the billing cycle, the member will be charged the next months membership fee

The member understands and acknowledges the dangers that can be present in using the equipment and/or tanning beds at a 1st Place Fitness Center facility. By signing this agreement, the member acknowledges that he/she has read and fully understand the contents of the warning statement for the use of the tanning beds at 1st Place Fitness Center. By signing this contract, the member hereby releases 1st Place Fitness Center of any and all responsibility and liability that accompanies any accidents, expenses, or other occurrences within and on the property of the facilities. 1st Place Fitness Center is not liable for any injuries or damages to any member(s), non-member(s) or guest(s), or the property of any member(s), non-member(s) or guest(s), or will be subject to any claim, demand, injury or damages whatsoever, including without any limitations, those damages resulting from acts of active or passive negligence on the part of 1st Place Fitness Center. The member understands that he/she is responsible for any damages to the facilities, equipment, property, and for any personal injury or property damage caused by the member to any other member(s), non-member(s) or guest(s).
Member(s) or guest(s) between the ages 16 to 18 years must have written consent and a signed liability waiver from a parent or guardian to use the equipment at 1st Place Fitness Center. Member(s) or guest(s) between the ages 13 to 15 years must have written consent, a signed liability waiver from a parent or guardian and must be accompanied by an adult at all times.
Members between the ages of 16 to 18 years old must have written consent, a signed liability wavier from a parent or guardian and must be accompanied by an adult when using the tanning beds at 1st Place Fitness Center. Members under the age of 16 must be accompanied by an adult AT ALL TIMES and are prohibited from using the tanning beds.
Member understands that he/she shall not give anyone else their assigned pin number or another member’s pin number to access the facility/facilities. Member understand that he/she shall not allow non-members access into the facility/facilities. In the event a member gives out a pin number to a non-member or allows non-members access to the facility, 1st Place Fitness Center has the right to terminate the contract immediately and require remaining amount of monthly dues, on the initial contract, to be paid within 30 days and remove access to the facility immediately. If the contract is a paid-in-full membership, 1st Place Fitness Center has the right to terminate this contract early, remove access to the facility and will not return any dues/fees that were paid.
Member understands they are responsible for any guest(s) they bring into the facility. Member understands they are responsible for any injuries or damages caused by the guest to the facility, to another member or non-member. Guest(s) without a contract are not permitted to use the facility/facilities unless guest fee of $5 is paid and guest waiver is signed. Guest(s) must be accompanied by the member at all times. Guest are NOT ALLOWED TO USE THE TANNING BEDS. Guest fee(s) and guest wavier(s) form must be placed in guest box prior to any activity at the facility. I understand that as a member of 1st Place Fitness Center I will not leave children or guest(s) unaccompanied.
Tanning Bed Warning Statement
• Failure to use the required eye protection provided to the customer may result in damage to the eyes.
• Overexposure to ultraviolet light may cause severe sunburn reactions;
• Repeated exposure to ultraviolet light may result in skin cancer and premature aging of the skin.
• Abnormal skin sensitivity or severe burning may be caused by reactions when tanning devices are used in conjunction with certain foods, cosmetics, and medications such as tranquilizers, diuretics (fluid pills), antibiotics, high blood pressure medicines, and birth control pills.
• An individual taking prescription medication or over-the-counter drugs should consult a physician before using a tanning device.
• An individual with skin that tends to burn easily, freckles, or never tans should avoid use of a tanning device before consulting a physician.
• An individual with a family or personal past medical history of skin cancer should avoid use of a tanning device.
• An individual should allow a minimum of twenty-four (24) hours between uses of a tanning device.
• Pregnant women or women using oral contraceptives may develop discolored skin due to the use of tanning devices.

An Annual Fee is due on all memberships and is $39.99. The Annual Fee of $39.99 will draft on the 2nd month after join date on the 1st of that month and again every 12 months on the same date so long as your membership remains in effect. The purpose of the annual fee is to guarantee that there will be no increase in your monthly dues during the term of your membership.

Month-to-Month Membership:
Member, stated above, authorizes 1st Place Fitness Center to withdraw monthly dues from my bank account or credit card each month. Payments will be withdrawn month to month from member’s bank account or credit card until membership is canceled. Member understands if they are the primary member of the account, they are responsible for payments for all other members listed on the contract. For members selecting to debit monthly dues from their bank account, if account overdrafts, you will be charged a $25 overdraft fee per occurrence. For members selecting the debit/credit card option, if the debit/credit card declines, the member will be charged a $10 decline fee. Members will be given one time waiver of the decline fee.

Paid-in-Full Membership:
Member, stated above, authorizes 1st Place Fitness Center to withdraw a one-time payment for the total amount of the membership on the billing cycle chosen above, unless membership is paid with cash or check. Once length of membership is up, the contract will be terminated and access to the facility will be removed unless member has notified 1st Place Fitness otherwise.

By signing this contract, the member, listed above, understands that they have signed an installment promissory note. Failure of the member(s) to use the membership does not relieve the member of their liability for payment, regardless of circumstances. Membership cannot be terminated until after the duration of the initial membership, listed above, regardless of circumstances. Once the duration of the initial membership has passed, the contract will automatically roll to a month-to-month contract. 1st Place Fitness Center will not pause, terminate, or refund any memberships if one of the facilities is required to close for any circumstances. In the event 1st Place Fitness Center is required, by law, to close both facilities, monthly drafting of memberships will be paused and will resume when one of the facilities reopens. Any time lost will be added to the end of the membership and the initial contract length will be extended for the duration both facilities were closed. Member will be billed the same amount and on the same day as the initial membership. Member is responsible for canceling membership. To cancel membership, member must notify 1st Place Fitness Center, with a 15-day notice, via email to [email protected], voicemail on gym phone number (256-943-1129) or directly contacting 1st Place Fitness Center staff member. 1st Place Fitness Center reserves the right to check that members on the contract are immediate family members. If members are children, they must be 21 or under and live in the same household. 1st Place Fitness Center reserves the right to remove any member(s) that are not immediate family, children 25 or under and live in the same household off the membership. 1st Place Fitness Center reserves the right to move the primary member and additional members (that are immediate family) to the correct membership type. The primary member will be responsible for the monthly membership payment.
