Member registration

MEMBERSHIP FEE: Your membership fee entitles you to all the rights and privileges of membership at Island Gym and Fitness (the club).  You agree that by signing this contract, you are required to pay for all membership dues and on-account charges whether or not you utilize the services of the club.  Unless within 3 days of the contract begin date, this agreement cannot be cancelled or payments withheld during the initial term.  In order to terminate billing during the open renewal period, you must formally apply for cancellation of this contract in writing (see below).  If the member wishes to cancel this contract within the initial term, the member must pay a cancellation fee of $96.00 or the balance of the contract whichever is less.  BILLING: All accounts with a balance due for membership or on-account charges will be processed/drafted daily.  PRICE INCREASE:  Island Gym and Fitness reserves the right to increase membership dues at any time.  LATE FEE:  If your account is past due (1) day, a late fee of $15.00 will be imposed.  This applies to every (all) individual past due invoices on account 15 days past due. AUTOMATIC OPEN RENEWAL: Upon the expiration of your initial membership term, your scheduled payments will continue in accordance with the contract for the rate and frequency as outlined. Your membership dues will not increase as long as your payments stay current, your credit is in good standing, and you do not apply for cancellation of this contract. Please be advised that scheduled dues payments in the open renewal period will continue indefinitely until you apply for cancellation.  See below for cancellation policy and procedures.

THIS AGREEMENT made and entered into by and between GRAHAM HOSPITAL ASSOCIATION (hereinafter referred to as “Hospital”) and member named above, (hereinafter referred to as “User”).
WHEREAS, Hospital owns and operates a “Wellness Center” as part of its Hospital operations containing exercise equipment appropriate for physical fitness; AND
WHEREAS, User is desirous of using the equipment during hours when they are not scheduled for work; AND
WHEREAS, Hospital is willing to permit the use of the equipment by its members with the understanding that it is to be used only on their own time and without any liability for injuries User may incur while exercising at the facility; AND
WHEREAS, on occasion User may be under the direction of Hospital at remote locations for class or programs and this release is intended to cover those circumstances as well;
WHEREAS, under a public health emergency, every user will be required to abide by all the hospital ordained safety practices during their participation in any Wellness Center activity (indoor gym access and classes, and outdoor/offsite classes). Failure to abide by these practices will result in the revoking of User’s membership. Safety practices will remain current with Illinois Department of Health or Centers for Disease Control requirements and will be posted throughout the facility.
NOW THEREFORE, in consideration of the mutual promises, covenants and conditions contained herein the parties agree as follows:
1. Hospital will allow User to use the physical fitness equipment located at their Wellness Center, or remote locations so long as its use is during time when User is not scheduled to work or has been given prior approval by their supervisor (for employees).
2. User understands and agrees that the use of this equipment is to be done on their own time and that Hospital is not providing them with any physical fitness services other than allowing them to use the equipment. User will be solely responsible for designing their own fitness program and using the equipment in a responsible way.
3. User agrees to release Hospital from any and all claims for damages they have for User’s improper use of the training equipment, User’s improperly designed exercise plan or for any other injuries whatsoever that they may incur while on the premises while using the Wellness Center or programs sponsored by the Wellness Center at remote locations for their own personal purposes to the maximum extent permissible by law. The claims which User are releasing are those for personal injury to themselves, loss of employment because of their injuries, damages for medical expenses, personal care or any other damages which may be associated with injuries User would receive while using the equipment at Hospital’s Wellness Center or entering upon the premises of the Hospital’s Wellness Center.
4. If Hospital is required to defend any claim for damages filed by User, then User agrees to pay Hospital’s attorney fees and costs in connection therewith.
5. User understands that this Release is intended to cover the negligence of User while using the equipment or any alleged negligence of Hospital’s Staff during the use of the equipment.
6. User understands that the building has 24/7 surveillance and the User is subject to this surveillance.
7. User agrees that they have been made aware of the GWC Emergency Plan policy and procedure, and have read and understand it, as well as know where to locate a copy of it.
8. This Release Agreement is binding upon the heirs, executors, administrators, assigns, and any other person who derives a claim of damages arising as a result of this agreement from User.
9. At its option, the Hospital may elect to provide voluntary personal training services or classes to Users under this agreement. User understands, acknowledges, and agrees that they are releasing any claim of liability in connection with any personal training class or service purchased as part of this Agreement to the maximum extent permitted by law, including any incidental or consequential damages they may allegedly incur. User specifically acknowledges that they may provide information about their physical or medical condition to the Hospital when signing up for their classes, that the Hospital may rely on that information, and that the User waives liability for any harm arising out of their provision of incorrect information; provided, however, that the foregoing is only an example of liability waived and not a limitation on the waiver of liability herein.
I agree that I know my physical limitations and will not exceed them during any exercise class provided by the Graham Wellness Center staff, or during use on the Graham Wellness Center equipment. Furthermore, if I have a condition that would increase risk of injury or illness with exercise; I will seek physician (M.D. or D.O.) clearance prior to starting this exercise program.

Graham Wellness Center offers 24/7 access to its members. These members have monthly fees that are due on the 15th of the month. If they are not paid by the 20th of the month, your membership will be canceled and there will be a $10 reinitiating fee. Employee and employee spouse/significant other memberships will be payroll deduct. Participants will use their I.D. Badge for access to the building. There is a $10 badge initiation fee and $10 for replacement of a lost badge. Badges are not to be shared. All participants will be subject to 24/7 video surveillance.
By signing this authorization form, the member agrees to the following conditions:
1. Sign any/all Release Agreements as required by Graham Hospital Association.
2. Abide by the policies and procedures of the Wellness Center.
a. Policies and procedures include the safety precaution requirements (during a Public Health Emergency) set forth in the Release Agreement/Waiver.
b. A copy of the policies and procedures is emailed to all new members upon account creation so long as email is provided. You can request a new copy of your paperwork by contacting wellness center staff at (309)647-4087.
3. Remain in the designated exercise area.
4. Report any equipment malfunctions to the Wellness Coordinator by phone at (309)647-4087, by email at [email protected], or by leaving notice on the whiteboard of Randy’s office door.
5. Will not bring or provide access to non-members into the Wellness.
6. Report lost badge to the Wellness Center staff immediately
7. TV’s will be available for use; however, you must provide your own music and be respectful of others in the room.
8. Water and towels will be available for use, please be respectful of usage.

If any of the above conditions are not followed, membership will be canceled. Members will be liable and financially responsible for the actions of themselves, and any other parties linked to their account.

Employee membership fees will be payroll deducted unless otherwise requested. Employee will be held liable and financially responsible for the actions of themselves, spouse, and/or significant other.
Violation of policies will lead to discipline up to and including termination.
