This membership will automatically renew at the end of original term on a monthly basis. Membership will continue to renew until member fills out a cancellation form. Membership will cancel 30 days after receipt of signed cancellation form provided original term is complete. Paid in full memberships cancel at end of original term.
WAIVER of CLAIMS. Agreement between undersigned applicant and Powerhouse Gym (The Club) The member expressly agrees that all use of all club facilities, exercise equipment, exercise machines, aerobics floors, yoga floors, locker rooms, and showers. As well as classes, personal training sessions, seminars, and any and all club services, including transportation provided by club is undertaken by member and or guest and his or her sole risk. The member further agrees that the Club is not liable for injuries or damages to any member, or his/her guest or the property of member or guest. The member agrees that the Club is not subject to any claim, demand, injury or damages whatsoever, including without limitation, those damages resulting from acts of active or passive negligence on the part of Club, its owners, managers, agents, employees, or contractors. The member for himself/herself and on behalf of his/her guests, executors, heirs, administrators, assigns or successors hereby expressly and forever, release and discharge the Club, its owners, managers, employees, agents, or contractors. from all such claims, demands, injuries, damages, actions or causes of action. The member agrees the Club is not liable or responsible to members for articles lost , stolen, in or about the Club, or in its lockers, or loss or damage to any property including but not limited to automobiles. Members agree not to store any articles of value in lockers.
I agree that my marks in signature area of this membership will be the electronic representation of my signature, regardless of how it close it looks to my paper signature, for all purposes when joining the gym. And shall serve as legally binding for the purpose of this facility and any of its related business, including personal training, just the same as pen-and-paper signature.
Agreement between undersigned applicant and Powerhouse Gym (The Club)
NATURE OF MEMBERSHIP - Membership grants solely the right to use and enjoy the premises of the Club in accordance with Clubs rules and regulations, which may change without notice from time to time. Membership does not carry with it any interest in the property or assets of Club. Membership does not give any right to members to participate in management of the club or otherwise. Club reserves the right to refuse service to any member for any reason. No colors, cuts or gang related articles are permitted at anytime.
NON DISCRIMINATION - Membership is open to any person , family, business or corporation of good character and responsible credit background. Club policy is to accept applications for membership without regard to race, creed, color, sex, sexual identity, political affiliation, or nationality.
APPROVAL OF MEMBERSHIP - All applicants and agreements must be in form prescribed by Club. Approval is subject to payment of all fees required to purchase membership. Only persons 18 years or older may purchase membership, or by parental consent on this form.
DUES - The Club shall from time to time, determine the amount and terms of payment of dues payable by members. The obligation to pay dues in not dependent upon availability of the Club or the frequency of use by member. Repairs, maintenance and/or other occurrences may make it necessary to restrict use or close club temporarily. The Club will not reduce or suspend dues at anytime or for any reason. Dues can increase by a maximum of 10% annually without notice.
TAXES- The Club will increase dues and apply any and all taxes, federal, state, and local as needed and mandated by authority.
TRANSFER OF CONTRACT - Club may transfer contract to independent institution or collection of dues, services, and goods sold. Or any other fitness facility.
RENEWAL MEMBERSHIP - If this is a renewable membership, your membership will continue on a monthly basis with no additional initiation fee. Rates can increase by no more than 10% per year. To cancel simply fill out a cancellation form at the front desk giving 30 days notice, member will not owe any further dues after the 30 days notice period and expiration of original term. Member will have to re apply at new rates to re instate membership.
VOLUNTARY RESIGNATION - The Club requires 30 days notice in writing to cancel a membership. Resigning member must complete and sign a resignation form and deliver to the Club. Resignation is not effective until the expiration of the 30 days notice period and completion of the original term of the contract. No further dues are owed after the expiration of the original term together with the effective date of the resignation form completion.
INVOLUNTARY TERMINATION - The Club reserves the right to terminate or suspend the membership or privileges of any member at any time. Club may terminate membership for failure to follow rules or regulations adopted by Club or for conduct the Club determines to be inappropriate or that in any way undermines the best interests of the Club. Suspension or termination may be delivered by Club in any form, writing, or verbal Terminated member remains liable for any dues, fees, or charges incurred.
REGISTRATION: Members must check in at front desk each time they enter the club.
AMENDMENTS Of RULES : The club may from time to time amend the rules and regulations. Additionally, the club may adopt new rules, regulations and policies not covered herein, without notice. All members and guests agree to comply with such rules regulations and policies.
