MEMBERSHIP FEE: Your membership fee entitles you to all the rights and privileges of membership at Island Gym and Fitness (the club). You agree that by signing this contract, you are required to pay for all membership dues and on-account charges whether or not you utilize the services of the club. Unless within 3 days of the contract begin date, this agreement cannot be cancelled or payments withheld during the initial term. In order to terminate billing during the open renewal period, you must formally apply for cancellation of this contract in writing (see below). If the member wishes to cancel this contract within the initial term, the member must pay a cancellation fee of $96.00 or the balance of the contract whichever is less. BILLING: All accounts with a balance due for membership or on-account charges will be processed/drafted daily. PRICE INCREASE: Island Gym and Fitness reserves the right to increase membership dues at any time. LATE FEE: If your account is past due (1) day, a late fee of $15.00 will be imposed. This applies to every (all) individual past due invoices on account 15 days past due. AUTOMATIC OPEN RENEWAL: Upon the expiration of your initial membership term, your scheduled payments will continue in accordance with the contract for the rate and frequency as outlined. Your membership dues will not increase as long as your payments stay current, your credit is in good standing, and you do not apply for cancellation of this contract. Please be advised that scheduled dues payments in the open renewal period will continue indefinitely until you apply for cancellation. See below for cancellation policy and procedures.
By signing this agreement, the undersigned has no medical or physical condition or history which would prevent him/her from using all or any of the Clubs` facilities, equipment and /or services. Guest and members` guests (adults or minors) assume the risk of any and all accidents or injuries of any kind which may be sustained by reason of or in connection with use of the Clubs` facilities, and release, discharge and absolve CPFC,LLC its agents and employees, from any and all liability or responsibility except if such accident or injury is the result of the negligence of CPFC, LLC its agents or employees.
CLUB ANNUAL FEE: Each member enrolled in a " Basic " or "Premium" membership having guaranteed monthly dues will be required to pay a $59.00 Annual fee in addition to their monthly dues. The Annual fee will be charged the month following your sign up month. The fee is charged once yearly as long as you`re a member. Any break in membership will result in a new annual fee to be charged upon reactivation.
INITIATION FEES, DUES, AND CHARGES 1.Payment of Initiation Fee. All new members shall pay an initiation fee to the Club. The amount, manner and time of payment of such fee shall be established by the Club and may be changed from time to time. 2.Dues. The Club shall, from time to time, determine the amount and terms of payment of dues which shall be payable by the members. The obligation to pay dues is not dependent upon the availability of all of the Club’s facilities. Repairs, maintenance and/or other events or occurrences may make it necessary for the Club to restrict the use of one or more of the facilities or to close, temporarily, the Club. 3.Charges. The Club shall, from time to time, fix the amount and terms of payment for charges for goods, services and use of the facilities by members and guests. In the event of default, the Member’s account shall be turned over to a collection agency. Should the matter go to court, the Member shall be responsible for any and all collection fees and/or attorney and court costs incurred by the Club if it prevails. 4.Service Fees. There shall be a charge for checks that are returned for insufficient funds, closed accounts, stopped payments and all credit card returns in the amount of $20.00. There shall also be a charge for lost membership cards. 5.Late Payment/Collection Terms Should you default on any payment obligation as called for in this agreement, the entire remaining balance shall be deemed due and payable upon demand, and you agree to pay allowable interest and all cost of collection, including, but not limited to, collection agency fees, court costs and attorneys` fees. Should any monthly payment become more than 10 days past due, you will be charged a 5% late fee of amount to be collected to cover additional administrative expenses and other expenses related to obtaining your payment. A $20 fee will be charged for all returned payments due to lack of sufficient funds in account. RULES AND REGULATIONS 1.Registration. Members must check in at the front desk and present their membership cards. 2.Guest Policy. The Club reserves the right to limit, restrict, regulate or prohibit the admission of guests. 3.Loss of Membership Card. If a members loses his/her membership card, he/she must pay a fee for any additional card issued. 4.Attire. Proper attire is required. Shirts and shoes are required in all public and recreational areas. 5.Damages. The member shall pay for all damage to the Club’s property caused by the Member or the Member’s guest. 6.Hours. The Club reserves the right to establish the hours during which the Club will be open. The Club reserves the right to close the club and/or reduce its hours of operation on holidays or during inclement weather. It further reserves the right to adjust the hours of operation on a reasonable basis to reflect member usage. 7.Children. Children through the age of sixteen (16) must be accompanied by a member at all times while in the building. Children are not allowed in the Aerobic Studios, Weight room (free and circuit), the Cardiovascular Centre or Steam rooms. AMENDMENT OF RULES AND REGULATIONS The Club may, from time to time, adopt other rules, regulations or policies not herein covered and all members will be obligated to comply with such rules, regulations and policies. If new rules or regulations are adopted, they will be displayed at the Club as “Additional or Substitute Rules and Regulations.” Changes in the monthly dues shall not constitute an amendment requiring any such display.
