Member registration

As a participant in the EFT Payment Plan, I authorize Force Fitness Club, LLC to charge the agreed upon monthly amount against my credit card/checking account as fulfillment of my contracted membership payment obligation as specified above. I understand that these monthly payments are validated with this agreement and that my monthly bank statement shall be my only record of payment.

Membership Draft Rollover: Membership is continuous. All members paying by Bank/CC draft will have their payments roll over automatically at the end of the year unless you give FFC a 30-Day written cancellation notice. A $80 Enhancement Fee is deducted from your account 60-Days from the start of your membership and then yearly on that date. This fee is used to enhance the Facility & Programming. You may cancel your automatic payment plan with 30-Days written notice.

This Notice provides important information about your payment options:

You may make payments on an installment basis or in a single payment. Paying the full amount may be less expensive, but may involve financial risks to you. Read this notice carefully before making a decision.

New York State Law requires certain health clubs to post a bond or other financial security to protect members in the event the club closes. This club is exempt from this requirement since it gives members the option of paying on an installment basis, therefore it need not post a bond or other form of financial security. In deciding whether to make your payments on an installment basis, you should be aware that if the club closes, although the club will remain legally liable for a refund, you may risk losing your money if the club is unable to meet its financial obligations to members.

I hereby give Force Fitness Club, LLC, its successors and assigns, and those acting under its permission or upon its authority, permission to copyright and/or publish whether by use of standard media or electronically, any photograph or video of myself and family and to keep changes in or additions to such photographs, portraits, in such manner as shall seem proper for their use. I also give permission to Force Fitness Club, LLC, to add me to their Texting/Email lis in addition to their bi-monthly newsletter.

My signature below indicates that I have read this entire membership application, including the waiver and release and club rules and policies, and that the staff has answered any questions I might have had regarding this membership application to my satisfaction. Furthermore, by my signature below, I am fully accepting responsibility for my actions as it pertains to this membership application and my actions as a member of the club.
You may cancel this contract without any penalty or further obligation within three (3) days from the date of this agreement and receive full refund on down payment.

You may also cancel your annual contract for the following reasons: Upon a doctor`s order with written documentation, if you move your residence more than 25 miles from any health club operated by owner and you must bring proof of address change. Lastly, if the services cease to be offered as stated in the contract.

IN CONSIDERATION of being permitted to utilize the facilities, services and programs of FFC for any purpose, including, but not limited to observation or use of facilities or equipment, or participation in any off-site program affiliated with FFC, the undersigned, for himself or herself and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has or immediately upon entering or participating inspect and carefully consider such premises and facilities or the affiliated program. It is further warranted that such entry into FFC for observation or, use of any facilities or equipment or participation in such affiliated program constitutes an acknowledgment that such premises and all facilities and equipment thereon and such affiliated program have been inspected and carefully considered and that the undersigned finds and accepts same as being safe and reasonably suited for the purpose of such observation, use or participation.

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER FFC FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO OBSERVATION OR USE OF FACILITIES OR EQUIPMENT, OR PARTICIPATION IN ANY OFF-SITE PROGRAM AFFILIATED WITH FFC, THE UNDERSIGNED HEREBY AGREES TO THE FOLLOWING:

THE UNDERSIGNED HEREBY RELEASES, WAIVES, DISCHARGES, AND CONVENANTS NOT TO SUE Force Fitness Club, LLC, its owners, directors, officers, managers, employees, independent contractors, instructors, personal trainers and agents (hereinafter referred to as”releasees”) from all liability to the undersigned, his personal representatives, assigns, heirs, and next of kin for any loss or damages, and any claim or demands therefore on account of injury to the person or property or resulting in death of the undersigned, whether caused by the negligence of the releasees or otherwise while the undersigned is in, upon, or about the premises or any facilities or equipment therein or anticipating in any program affiliated with Force Fitness Club, LLC.

THE UNDERSIGNED HEREBY AGREES TO INDEMNITY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may incur due to the presence of the undersigned in , upon or about FFC premises or in any way observing or using any facilities or equipment of FFC or participating in any program affiliated with FFC whether caused by the negligence of the releasees or otherwise.

III. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to negligence of releasee or otherwise while in about or upon the premises or FFC and/or while using the premises or any facilities or equipment thereon or participating in any program affiliated with FFC.

IV. I declare that I have completed the FFC’s pre-activity screening questionnaire and/or health/medical information questionnaire and that I am physically able to participate in physical activity. Furthermore, I acknowledge that FFC has advised me to obtain a physician’s clearance in the event the answers on either the pre-activity screening questionnaire and/or health/medical information questionnaire indicates that I should not participate in a program of physical activity without a physician’s clearance, or if FFC is unsure of my physical health yet I maintain that I am physically capable of pursuing physical activity in FFC without such steps being taken or has done so. THE UNDERSIGNED further expressly agrees that the foregoing RELEASE, WAIVER, AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of New York and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force an effect.

THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE REEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.

I HAVE READ THIS RELEASE.

I understand that there is a $75 Enhancement Fee, charged one time yearly, approximately 60 Days after joining charged to my billing provided here.

I hereby give permission to Force Fitness Club LLC, its successors and assigns, and those acting under its permission to upon its authority, permission to copyright and/or publish, whether by use of standard media or electronically, any photograph or video of myself an family and to keep changes in, or additions to such photographs, portraits, in such manner as shall seem proper for their use. I also give permission to Force Fitness Club, LLC to add me to their Texting/Email List in addition to their Bi-Monthly Newsletter.

- For your protection, FFC advises against bringing items of value onto the premises. FFC is not responsible for lost or stolen valuables. There is no smoking allowed anywhere on the premises.

Force Fitness Club, LLC, management reserves the right to utilize facilities for special events, private parties, tournaments or other activities it may deem desirable. Therefore, sections of, or the whole facility may be closed to use when necessary.

By signing this contract you are also giving Force Fitness Club, LLC, permission to email and text you.

If there is a membership rate change, Force Fitness Club, LLC agrees to notify me thru email or physical letter at least 30 Days before the new rate goes into effect.

I understand that if my payment obligation is not met, a service charge of $15 will be applied and I will be unable to use the facility until my obligation and service charge are paid.

I understand that I am entering a contract as specified above and that after the contracted time ends my membership Auto-Renews on a monthly basis and I must give 30 Days written notice to Force Fitness Club, LLC in order to stop it.

I understand that there is an $80 Cancellation Fee should I choose to break the contract and that I must give 30 Days Notice.
