EFT PAYMENT PLAN: Dues are payable monthly and collected by' electronic fund transferring (EFT) for the full term of the membership.
After the full term of the membership, the Club retains the right to increase renewal dues. Registration fees are non-refundable.
Late charges of up to $15.00 applies to late payments. Returned/dishonored checks are subject to a fee of up to $20.00.
A. NO ASSIGNMENT BY BUYER OR MEMBER: This contract and the rights of the membership are not assignable by the buyer or member:
B. WARRANTY OF MEMBERS FITNESS: Buyer and member warrant that member is in good physical condition and he/she has no disability, impairment or ailment preventing him/her from engaging in active or passive exercise or that will be harmful to his/her health, safety, comfort, or physical condition if he/she does engage or participate in activities.
C. ENTIRE AGREEMENT: This Contract constitutes the entire and exclusive agreement between the parties. Any promises, representation, understanding or agreement pertaining directly or indirectly to this Contract which are not contained herein, are hereby waived. This Contract may be modified only by an instrument in writing.
D. LIMITATION OF LIABILITY: Member shall participate in physical conditioning and/or use the gym's facilities, services or equipment at his/her -own risk.
E. VALUABLES AND PERSONAL PROPERTY: Members are urged to avoid bringing valuables onto the gym premises. ABSOLUTE POWER, its affiliates, agents or employees shall not be liable for the loss, theft of, or damage to, the personal property of member or guests unless deposited with the manager or assistant manager with a written receipt. Managers and assistant managers are authorized to accept such property solely for the benefit of members. In no instance shall the gym's liability exceed $100.00.
F. RULES AND REGULATIONS: Member-agrees to abide by and obey all the rules and regulations reasonably established by ABSOLUTE POWER or its agents for the best interest of the membership, whether posted or communicated orally, including but not limited to behaving so as not to disturb, annoy or endanger others. ABSOLUTE POWER reserves the right to revoke privileges for infractions or violations by member of rules and regulations or the terms of this contract. Upon such revocation, no part of fee shall be refunded and any unpaid portion thereof shall become immediately due and payable.
G. LOCKERS: Lockers are provided solely for the benefit and convenience of members. Member is urged to place his/her own lock on locker for protection of his/her property during member's visit to the gym. Management reserves the right to clip any lock left on a locker overnight.
H. BUYER'S INDEMNITY AGREEMENT: Buyer assumes full responsibility for any person who becomes a member under this agreement and shall indemnify ABSOLUTE POWER, its affiliates, agents and employees against any and all liability incurred by them to such member who does not become a signatory.
I. ID CARD: Member assumes full responsibility for producing proper ID at each time of entry. Member will receive an ID card issued by ABSOLUTE POWER. Il) cards are-nontransferable and if lost require a $10 replacement fee.
J. REFUNDS: Absolutely no refunds. ABSOLUTE POWER does not freeze membership.
L. NO TRANSFERRING MEMBERSHIP.
FACILITY RULES:
The membership will be charged a $129.00 cancellation fee if cancellation is made at any time during the member's initial 12 month membership.
No Member will be admitted without their ID card OR photo identification. All Belongings must be kept in lockers, including keys.
Proper workout attire is mandatory. Sneakers and shirts MUST be worn. No jeans. No work Boots. No Street Clothes.
Failure to use gym does not release member from their contractual obligation to pay membership dues for the duration of this contract.
To avoid a re-registration fee, late charges, etc. you must keep your membership current.
If applicable, upon your renewal date, subject to inflationary increases, your monthly dues will continue until you choose to stop. There will be no re-registration fee. But there is an annual maintenance fee in the sum Of $49.00
Cancellation of membership after completion of your initial contractual obligation must be in writing signed by the Member and sent by Certified U S. Mail and received by Absolute Power, at least 30 days prior to your requested cancellation date. Cancellation may also be made by the Member in person at the GYM. Your membership will be charged for that 30-day period. Until the time that ABSOLUTE POWER is in receipt of your signed cancellation notice.
I have read and received a copy of this contract and the rules governing payments of dues, renewals and cancellation; lost or stolen cards, limitations of liability, warranty of member's fitness management's right to cancel or revoke memberships, refund policy, member's right to cancel and member's liability of costs/fees in the event of default of payment by member. I further agree to all the terms and conditions.
