NOTICE OF DUES RENEWAL: Following the initial 1 year membership term, your membership agreement will automatically continue on a month-to-month basis until a 30-day advance written notice is given by either party. Buyer`s notice must be sent certified mail to Norwell Athletic Club at 412 Washington St Norwell, MA 02061. Any additional service(s) will also continue monthly until the same requirement to provide a written notice of cancellation. All payments must be current to terminate the membership agreement. Buyer owes all monthly payments until proper cancellation procedures have been followed.

By signing this Agreement, You, the Buyer or Member, for yourself and for any additional members under this Agreement, your spouse, your parent, your child or guest, as may be applicable, agree that if You or they are present for any reason at Norwell Athletic Club, including engaging in physical exercise or activity, you do so at your own risk. This includes, but is not limited to, your use of exercise equipment, weights, locker rooms, tanning facilities, showers, saunas, steam rooms, parking areas, sidewalks, and your participation in any activity, class, program, personal training or any other instruction or facility now provided or made available in the future. You agree that you are voluntarily using the equipment and facilities and participating in these activities and, therefore assume all risk of injury or risk of contraction of any illness or medical condition that might result therefrom or any damage, loss or theft of any personal property. Further, You agree on behalf of yourself and the others identified above to release and discharge Norwell Athletic Club, including its affiliates, employees, agents, representatives, successors and assigns, from any and all claims or cause of action arising out of their negligence. This Waiver and Release of liability includes, but is not limited to, injuries or damage that may occur as the result of (a) your use of any exercise equipment which may malfunction or break, (b) your use of any other equipment or facility that is improperly maintained, (c) Norwell Athletic Club improper maintenance of any exercise equipment or facility, (d) your slipping and falling while on the premises of Norwell Athletic Club or any affiliated club or facility or on the surrounding premises, (e) Norwell Athletic Club negligent hiring or negligent retention of any employee or independent contractor, (f) Norwell Athletic Club negligent instruction or supervision, or (g) first aid, emergency treatment, or any other gratuitous service which is negligently rendered or failed to have been rendered by released parties, emergency personnel, or any other person on the premises of Norwell Athletic Club or any affiliated club or facility. YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS AND PURPOSE, THAT NEITHER YOU NOR ANY OF THE ABOVE-NAMED RELEASING PARTIES MAY BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST NORWELL ATHLETIC CLUB AND OTHER RELEASED PARTIES FOR THEIR NEGLIGENCE OR THAT WHICH MAY ARISE OUT OF OR RELATE TO PARTICIPATION IN THE ACTIVITIES OR USE OF THE EQUIPMENT OR FACILITIES PROVIDED BY THEM UNDER THIS AGREEMENT. YOU FURTHER ACKNOWLEDGE THAT YOU HAVE CONVEYED THE TERMS OF THIS WAIVER AND RELEASE TO ALL PERSONS DESCRIBED ABOVE WHO MAY USE THE DESCRIBED EQUIPMENT AND FACILITIES PURSUANT TO THIS AGREEMENT AND THAT THEY HAVE AGREED TO THE SAME.

Norwell Athletic Club charges each member an Annual Club Enhancement Fee of $39.00. This fee will be assessed on January 15th each year. This fee will be included in the Members Electronic Funds Transfer for January 15th annually.

1.DISCLAIMER OF LIABILITY. Norwell Athletic Club urges all members to obtain a physical examination from their physicians prior to the use of any exercise equipment or attendance in any exercise class. In recognition of the possible dangers connected with any physical activity, member(s) hereby knowingly and voluntarily waive(s) any cause of action of any kind whatsoever arising as the result of such activity from which any liability may or could accrue to Norwell Athletic Club, its officers, agents, employees, instructors or assigns. 2.RULES AND REGULATIONS. Member Agrees to follow club rules as promulgated from time to time. Violation of these rules may be the cause for suspension or cancellation of membership. 3. SEVERABILITY. If any part of this contract shall be held invalid, that part shall be deemed excluded from this contract and the remainder of the contract shall remain in full force and effect. 4. ENTIRE AGREEMENT. The Member and Norwell Athletic Club acknowledge that this Agreement constitutes their entire agreement. It cannot be amended except in written form executed by both parties. 5. CANCELLABILITY AND TRANSFERABILITY. This membership is not negotiable, transferable or cancellable except as otherwise provided herein. This Agreement will bind and inure to the benefit of Norwell Athletic Club`s permitted successors and assigns. 6. ADDITIONAL RIGHTS TO CANCELLATION. Your or your estate may also cancel this contract for any of the following reasons: A. If, upon a Doctor`s order, you cannot physically or medically receive the services because of significant physical or medical disability for a period in excess of 3 months with a Doctors note stating such. B. In case of your death. C. If the health club services provided under this contract are not available because the seller (1) fails to open a planned health club or location; (2) permanently discontinues operation of a health club or location; or (3) substantially changes the operation of a health club or location; (4) If you move and your residence is now more than 25 miles from Norwell Athletic Club (5). NOTICES. Pursuant to Paragraph 5 of this contract, you will be required to provide reasonable evidence of the reason for cancellation and send it to: NORWELL ATHLETIC CLUB at 412 Washington St, Norwell MA 02061 (6). DURATION. The contract shall not be for a period of more than 12 months. If made for a greater period, it shall be deemed to be for 12 months only, notwithstanding any other provisions herein. The contract will be renewed at the end of its term under the provisions on page 1 of this agreement unless notified by member in writing and mailed to Norwell Athletic Club 412 Washington St norwell, MA 02061.
