This contract Is subject to cancellation by notice sent by registered or certified mall, return receipt requested, or personally delivered to: Naveslnk Fitness, 1006 HWY 36, Atlantic Highlands, NJ 07716 upon the buyer's death or permanent disability, If the permanent disability Is fully described and confirmed to the health club by a physician. In a cancellation under the subsection, the health club may retain the portion of the total contract price representing the services used plus reimbursement for expenses incured In an amount not to exceed 10% of the total contract price. ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENCES WHICH THE BUYER / MEMBER COULD ASSERT AGAINST THE CLUB AS A RESULT OF CONTRACT. RECOVERY BY THE BUYER / MEMBER SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE BUYER / MEMBER TO THE CLUB PURSUANT TO THIS CONTRACT. YOU THE BUYER MAY CANCEL THIS AGREEMENT FOR ANY REASON AT ANY TIME BEFORE MIDNIGHT OF THE THIRD OPERATING DAY AFTER THE BUYER RECEIVES A COPY OF THE CONTRACT. IN ORDER TO CANCEL A CONTRACT THE BUYER SHALL NOTIFY THE HEALTH CLUB OF CANCELLATION IN WRITING, BY REGISTERED OR CERTIFIED MAIL, RETURN RECEIPT REQUESTED, OR PERSONAL DELIVERY, TO THE ADDRESS ABOVE. UNDER NO CIRCUMSTANCES WILL AN E-MAIL BE ACCEPTED AS A CANCELLATION. ALL MONEYS PAID PURSUANT TO THE CANCELED CONTRACT SHALL BE FULLY REFUNDED WITHIN 30 DAYS OF RECEIPT OF THE NOTICE OF CANCELLATION. IF THE CUSTOMER HAS EXECUTED ANY CREDIT OR LOAN AGREEMENT THROUGH THE HEALTH CLUB TO PAY ALL OR PART OF THE HEALTH CLUB SERVICES, THE NEGOTIABLE INSTRUMENT EXECUTED BY THE BUYER SHALL ALSO BE RETURNED WITHIN IN 30 DAYS. THE HEALTH CLUB SERVICES CONTRACT SHALL PROVIDE THAT IF THE HEALTH CLUB FACILITY IS CLOSED FOR A PERIOD LONGER THAN 30 DAYS THROUGH NO FAULT OF THE BUYER OF THE HEALTH CLUB CONTRACT, THE BUYER IN ENTITLED TO EITHER EXTEND THE CONTRACT FOR A PERIOD EQUAL TO THAT DURING WHICH THE FACILITY IS CLOSED OR TO RECEIVE A PROTRACTED REFUND OF THE AMOUNT PAID BY THE BUYER UNDER CONTRACT. PLEASE NOTE THAT IF A MEMBER MOVES THEIR PERMANENT RESIDENCE MORE THAN 25 MILES FROM THIS HEALTH CLUB, THE MEMBER MAY CANCEL THIS CONTRACT UPON WRITTEN NOTICE. CANCELLATION EFFECTIVE UPON DATE OF NOTICE. A CANCELLATION FEE MAY NOT EXCEED MORE THAN 10% OF TOTAL CONTRACT PRICE.

The Club urges you and all members to obtain a physical examination from a doctor before using any exercise equipment or participating In any exercise class. All exer'- clses, Including the use ofwelghU and use of any and all machinery, equipment, and apparatus designed for exercising shall be at the member's sole risk.Member under•- stands that the agreements to use, or selection of exercise programs, methods and types of equipment shall be member's entire responsibility, and the Club shall not be liable to members for any claims, demands, injuries, damages,or actions arising due to injuries to member's person or property arising out of or In connection with the use of the Club. Member hereby holds the Club, It's officers, owners, agents and employees harmless from all claims which may be brought against them by member's behalf for any such injuries or claims.

ANNUAL MEMBERSHIP CLUB MAINTENANCE FEE OF $20 IS DUE MAY 1ST

DEFAULT: Should you default In your payment obligation, you agree to pay all costs of collection, Including court costs and attorneys' fees.
LATE CHARGE: If your payment Is late, you will be charged 5% of the payment.
