1. This agreement will be automatically renewed on a month-to-month basis. This agreement may be cancelled if the buyer notifies The Health Club according to Paragraph 2 (a) of this agreement at least 30 days prior to termination of the membership term. Buyer is subject to dues which equal 30 days of the prevailing monthly membership rate from the time of notification;
2. This agreement provides that:
a. to cancel an agreement, the buyer shall notify The Health Club of cancellation in writing, certified mail, return receipt requested, or personal delivery to: The Health Club 2301 36th Ave. NW Norman. Ok 73072;
b. all monies to be refunded upon cancellation of agreement shall be paid within thirty (30) days of receipt of the notice of cancellation;
c. If the customer had executed any credit or lien agreement with The Health Club to pay for all or part of health club services, any such agreement executed by the buyer shall also be returned within sixty (60) days after such cancellation;
3. This agreement provides for the full use of the facilities except as designated by signs posted throughout The Health Club or restrictions forth in this agreement.
It is expressly agreed that all use of the Club facilities shall be undertaken by a member at his/her own risk, and The Health Club shall not be held liable or responsible for any injuries or damage to any Member or guest, or be subject to any claim, demand, injury, losses, expenses, or damages whatsoever, including, without any limitations, those resulting from the intentional negligent acts r omissions of the part of The Health Club, its owners, employees, officers and agents. The Members, for himself or herself and on behalf of his or her executors, administrators, personal representatives and assigns do hereby forever release and discharge The Health Club, its successors and assigns, as well as its parent corporation, affiliate corporation, officers and agents, for all such claims demand, injuries, actions, losses, and expenses.
I have read and understand this agreement to be bound by the same. I specifically understand the following provisions are included in this agreement:
BUYER's RIGHT TO CANCEL
1. This agreement includes a penalty-free cancellation within three (3) business days of its making and a refund of all monies paid under the agreement;
2. This agreement may be cancelled if The Health Club relocated or goes out of business and fails to provide alternative facilities within eight (8) miles of the location designated in this agreement and refund an account computed by dividing the contract price by the number of weeks in the agreement term and multiplying the result b the number of weeks remaining in the agreement term;
3. The Health Club reserves the right to deny or discontinue membership to anyone for any reason.

7. I understand there is a $25.00 fee for each returned check or credit card draft.
NOTICE
ANY HOLDER OF THIS AGREEMENT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER.
