Member registration

Member understands that this Agreement is for the term set forth in Section A Membership Type and Fee and Member agrees to pay consecutive monthly installments as selected in the Membership Type and Fee Section until the expiration of the term. After the expiration of the term, Membership will NOT automatically cancel and Membership will continue on a Month-to-Month basis (meaning that you will be charged monthly based on the Month-to-Month rate at the time your term expires) until Member renews or cancels this Agreement. All requests for cancellation must be made in the manner prescribed in Section 4 and at least fifteen days before the next billing cycle, if not you will be subject to paying the following months dues.  Member authorizes recurring charges to the payment method(s) on file for dues, fees, taxes, and other authorized charges until cancellation becomes effective in accordance with Section 4. If rates change, we will provide advance notice as required by applicable law. To avoid renewal charges, timely complete the cancellation process in Section 4.

Member assumes full responsibility for his or her use of the facility and releases Vibe Fitness and/or the Club Owner from any and all claims, including those caused in whole or in part, by the negligence of Vibe Fitness and/or the Club Owner and shall indemnify Vibe Fitness, the owner of the club location the Member is utilizing, its affiliates, agents and employees against any and all liability arising out of use of the facilities. For purposes of this Agreement, the Club shall mean the LLC or Entity which owns the location facility operating under the Vibe Fitness Brand.; Vibe Fitness Clubs shall mean all locations operating under the Vibe Fitness Brand pursuant to a license or franchise agreement between such independent location and the Vibe Brand, to include without limitation Vibe Fitness IP LLC, it affiliates, related companies, officers, directors and employees. 

You understand that use of fitness facilities, equipment, classes, training, and programs involves inherent and other risks of injury, illness, death, and property damage, including from strenuous activity; misuse of equipment; actions or inactions of others; slips and falls; and exposure to communicable diseases. You voluntarily assume all such risks to the fullest extent permitted by law. To the fullest extent permitted by law, you release and discharge Vibe Fitness, the Club, and their respective owners, affiliates, directors, officers, employees, contractors, and agents from any and all claims and liabilities for personal injury, illness, death, or property loss or damage arising out of or related to your membership, presence at, or use of our facilities, equipment, services, or programs, even if caused in whole or in part by our negligence. This release does not apply to claims that cannot be released under applicable law.

You agree to indemnify, defend, and hold harmless Vibe Fitness and the Club Parties from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your (or your guests’ or minors’ under your care) acts or omissions, violation of this Agreement or the Policies, or use of the facilities, except to the extent caused by our willful misconduct.  Without limitation, Member shall indemnify and hold harmless Vibe Fitness from any claims, demands, actions, damages, or liabilities asserted by Member`s guests, invitees, or minors arising from their presence at or use of Club facilities, services, or programs.

To the fullest extent permitted by law, our total liability to you for any and all claims arising out of or related to this Agreement or your membership shall not exceed the total amounts you paid to us for membership dues during the twelve (12) months immediately preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

ALL ACCOUNTS ARE SUBJECT TO AN ANNUAL MAINTENANCE FEE OF $39.99, WHICH ACCRUES ON THE DATE OF SIGNING AND COLLECTED 90 DAYS THEREAFTER

Vibe Fitness — Agreement

1. AUTORENEWAL DISCLOSURE - REOCCURING BILLING: Member understands that this Agreement is for the term set forth in Section A Membership Type and Fee and Member agrees to pay consecutive monthly installments as selected in the Membership Type and Fee Section until the expiration of the term. 2. CONSUMER`S RIGHT TO CANCELLATION. MEMBER MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN THREE (3) DAYS FROM THE AGREEMENT DATE; IN THE MANNER PRESCRIBED IN SECTION 4 OF THIS AGREEMENT. All monies paid pursuant to this Agreement shall be refunded within fifteen business days of receipt of such notice of cancellation. If You executed any credit or loan agreement to pay for all or part of the club services, any such negotiable Instrument executed by the You will also be returned within fifteen days.

3. ADDITIONAL RIGHTS TO CANCELLATION; Member may also cancel this Agreement via 45 days written notice; in the manner prescribed in Section 4 for any of the following reasons: a. If upon a doctor`s order, Member cannot physically receive the services because of significant physical disability for a period in excess of six months. b. If Member dies, his/her estate shall be relieved of any further obligation for payment under the contract not then due and owing. c. If Member permanently relocates their primary residence to a location more than twenty-five miles from the nearest Club, (must provide satisfactory proof of new residence) d. If, within the first twelve months of membership, Members employment is Involuntarily terminated without cause (must provide a letter from former Employer confirming termination of employment and reason for termination); provided that any Member canceling under this sentence shall be required to pay an early termination fee of $100. e. If the services of the Club cease to be offered as stated in the contract.   All monies, except any initiation or sign-up fees, paid pursuant to such contract canceled for the reasons in this paragraph shall be refunded provided however, that the Club may retain the expenses incurred and the portion of the total price representing the services used or completed, and further provided, that the Club may demand the reasonable cost of goods and services which Member consumed or wishes to retain after cancellation of the contract. In no instance shall the Club demand more than the full contract price from the You. If You have executed any credit or loan agreement to pay for all or part of the health club services, such negotiable instrument executed by You shall also be returned within fifteen days. If You received any free months as an inducement to enter into this Agreement or as a result of referring new members, such free months shall not be considered in computing the amount of any refund to which You may be entitled.

4. CANCELLATION PROCESS: Notice of cancellation shall be in writing and signed by You, either in person (must get proof of cancelation if in person), via email or mailed via certified mail, return receipt requested to the Club; at the address specified herein.; Notice of cancelation may also be provided in the same manner in which the membership was purchased (Ie. If You purchased Your Membership via our Website then You may likewise cancel via this route). Such notice shall be accompanied by the contract forms, membership cards and any other documents of evidence of membership previously delivered or provided to You.  You must receive written confirmation from us for your cancellation to be effective. If you do not receive confirmation within ten (10) days, please contact us promptly. Cancellation takes effect at the later of the end of the then-current billing period following any required notice period or on a date required by applicable law.

5. DEFAULT AND LATE PAYMENT: Should You default on any payment obligation as called for in this Agreement, the entire remaining balances shall be deemed due and payable upon demand, and You agree to pay allowable interest and all costs of collection, including, but not limited to, collection agency fees, court costs and attorney fees. Should any month payment become more than ten (10) days past due, You will be charged a Ten ($10.00) Late Fee. The Club reserves the right to charge balances and overdue balances to their current account under the Electronic Funds Transfer Authorization.

6.  MEMBER`S HEALTH WARRANTY & MEDICAL REPRESENTATION: You represent that You are in good health and have no disability, impairment, injury, disease or ailment preventing from engaging in active or passive exercise or which would cause increased risk or injury or adverse health consequences as a result of naive or abusive exercise. You assume full responsibility for Your use of the facility and shall indemnify Vibe Fitness Clubs, the Owner of the Club location the member is utilizing, its affiliates, agents and employees against any and all liability arising out of use of the facilities.  You agree to follow all medical advice and safety instructions while using the facilities, equipment, services, classes, and programs, and you will not participate if you have a condition or are taking substances that could make participation unsafe.  You represent that you have consulted with a physician as needed and are capable of participating safely. You will immediately stop any activity that causes discomfort or pain and alert staff of any injury.  In the event of illness, injury, accident, or medical emergency occurring on Club premises or during participation in any Club activity, Member authorizes Vibe Fitness personnel to secure emergency medical treatment, transportation, and related services as deemed reasonably necessary. Member acknowledges that Vibe Fitness is not responsible for the cost of any such medical services and releases Vibe Fitness from any liability arising from obtaining or attempting to obtain such assistance.

7. RULES, REGULATIONS, POLICIES AND SCHEDULES: YOU agree to abide by all the membership rules, regulations policies and schedules of Club (https://vibefitness.com/vibe-fitness-policies)  which may be posted or issued orally, and which may be amended from time to time, at Management`s sole discretion.  Policies may be updated periodically and are effective upon posting at the club or on our website or upon notice to you.  Continued use after an update constitutes acceptance.

8. PRESENTATION OF MEMBERSHIP CARD: NO ONE will be admitted to Vibe Fitness clubs without displaying a valid membership card or registering as a guest.  You must present government-issued identification upon request to verify identity.

9. INDEPENDENT CONTRACTORS: From time to time we may make available to members and their guests the services of independent contractors. We do not warrant or guarantee the quality of these services and do not guarantee that these services will remain available to Members or their guests for any period of time, and hereby disclaim all liability arising out of such services.  Independent contractors are not our employees or agents, and they are solely responsible for their actions and omissions.

10. GUESTS: Member guests are permitted in the club, provided however they must be validly registered, sign required agreements, present valid ID, pay for a guest pass, and st comply with all Club rules, regulations, policies, fees, schedules as may then be in effect. Club reserves the right to limit the number of times any one guest can use the club / facility and reserves the right to exclude any guest whose use of the club / facility, in the sole opinion of the Club, would be detrimental to the club / facility or any of its members. Members are responsible for the conduct of their guests and for any resulting damages, fees, or rule violations.  Guest access and pricing may change without notice.

11. TRANSFERS OF MEMBERSHIP: Membership may not be transferred. Any attempted assignment or transfer is void.

12. UPGRADING MEMBERSHIPS: A Member may upgrade his or her membership (e.g., Core to Lux) with the prior consent of management; provided Member/Buyer will be responsible for paying an upgrade fee and for the ongoing payment of any additional monthly fees associated with such upgrade. In addition, transfer to a Club offering only upgraded memberships will result in an upgrade fee and additional monthly fees.

13. YOUR OBLIGATIONS: You shall not be relieved of Your obligations to make payments that were agreed to, and no deduction from any payments shall be made because of Your failure to use the club or its facilities. (Member dues are for the period of time and are no way related to or adjusted based on, actual usage of the club or facilities.)  Temporary closures or service modifications for maintenance, events, capacity limits, or circumstances beyond our reasonable control do not entitle you to refunds or credits, except as required by law.

14. UNPAID BALANCES: You will not be permitted to use the club or its facilities until all fees are current. You are also obligated to pay any collection and/or legal costs incurred by Club for collection of any fees. Annual dues must be paid by 12:00 midnight on the anniversary date or club privileges will be suspended. If suspended, renewal will be based on current available packages and will require new initiation or sign up fees. Club; reserves the right to charge balances and overdue balances to their current account under the Electronic Funds Transfer Authorization. If any check or credit card charge payable to Club; is not honored, You will be assessed a $10 charge for each check and credit card rejected.  Returned-payment fees may be adjusted to comply with applicable law. We may terminate or suspend access for nonpayment, in whole or in part, with or without notice as permitted by law.

15. VALUABLES AND PERSONAL PROPERTY: You are urged to avoid bringing valuables onto club premises. Club shall not be liable for the loss of or theft of, or damage to, the personal property of member or guests, including items left in lockers, with the coat check or elsewhere in the club or facility.  You assume all risk of loss for personal property brought to our facilities.

16. MEMBERSHIP FREEZE POLICY: Members that have 1 year or greater memberships may put their membership on hold, in one-month increments, for up to three (3) calendar months. A fee of $20 per month will be charged per freeze request. Notice of intent to freeze one`s account must be submitted to Club via email at no less than seven (7) business days prior to the freeze date. The freeze request must state both the freeze start date and reactivation date. Members who provide insufficient notice cannot be guaranteed a timely stop on billing. Members will not be billed for memberships during the freeze months. Billing will resume automatically upon end of freeze months.

17. GROUP FITNESS / CLASS RULES: Allow enough time to sign in before each class. Do not enter a class late or leave early unless You give the instructor prior notice. If You are just starting Group Fitness / Class or have a pre-existing Injury or problems that prevent full participation, please discuss the situation with the Group Fitness instructor before class. Aerobics shoes must be worn in all Group Fitness classes.  Class reservations may be required; late cancellation and no-shows will result in temporary suspension of class booking privileges.

18. DRESS CODE: Proper athletic attire and footwear required. No street clothes or dress shoes permitted in fitness area. Management has the right to prevent the use of any equipment if the proper attire is not worn. We may deny entry or require you to change attire to meet hygiene and safety standards.  Vibe has sole discretion to decide what counts as proper attire.

19. PRICING: Club reserves the right to increase the monthly or annual fee and will provide notice to You regarding any such change in pricing.  Changes to taxes or government-imposed fees may be passed through without advance notice if permitted by law.

20. TERMINATION AND SUSPENSION FOR VIOLATIONS. We may, in our sole discretion, immediately suspend and/or terminate your membership and access to any or all facilities, classes, services, and programs, effective upon notice, for any violation of this Agreement, the General Policies, any club rules, codes of conduct, safety instructions, or any policy as updated from time to time, or for conduct we determine, in our discretion, to be unsafe, disruptive, illegal, harassing, or detrimental to members, guests, staff, or property. Except as required by applicable law, amounts paid are nonrefundable, and you remain responsible for any unpaid balances through the effective date of termination. Our rights hereunder are cumulative of other remedies.

21. PERSONAL TRAINING and SPA SESSSIONS: All sales of personal training and spa sessions are final and non-refundable. Personal Training and spa sessions expire 180 days from the date of purchase. Sessions missed, canceled late, or no-showed may be forfeited and/or charged in accordance with the then-current cancellation policy.  Vibe Fitness makes no representations, warranties, or guarantees regarding weight loss, muscle gain, athletic performance, physical appearance, medical outcomes, rehabilitation, recovery, wellness improvements, or any other specific results arising from personal training, nutrition coaching, recovery services, spa services, wellness programs, or related offerings.

22. NON-VIBE FITNESS PERSONAL TRAINERS: Use of non-Vibe Fitness Personal Trainers in the Club is prohibited. Members may not personally train other members. We may remove or suspend any person violating this policy without refund.

23. PARKING: For locations that offer parking only,; If You have a 1 year or GREATER Membership, You may use our parking lot, on a first come first serve basis, based on availability, while using the Club or facility for a maximum of 2 hours subject to the following rules: a. Membership must be paid to date and Your vehicle must have a current, unexpired Club Parking Pass CONSPICUOUSLY displayed on the front windshield of Your vehicle. b. Make, Model and Plate of vehicle must be registered with Club. c. You shall notify Club of any replacement vehicles and receive a temporary pass for said vehicle. d. You must comply with all club / facility rules regarding procedure, security, safety, and preservation of the club / facilities. e. Parking privileges may be revoked at anytime, with or without cause, without any credit or abatement to Your membership due and fees. f. TOWING: IF YOU FAIL TO STRICTLY ADHERE TO THE ABOVE TERMS, CLUB SHALL HAVE THE RIGHT, WITHOUT FURTHER NOTICE TO YOU TO HAVE YOUR VEHICLE TOWED. YOU SHALL BE RESPONSIBLE FOR ANY AND ALL COSTS INCURRED WITH THE TOWING OF YOUR VEHICLE. g. You understand and expressly agree that the Club; is not responsible for loss or damage to any vehicle or its contents by fire, vandalism, theft or any other cause, nor for loss, damage or personal injury of any nature. Club; shall have no duty to provide security, and expressly does not assume any obligation to provide for the security of the parking area or to protect individuals using the parking area, or vehicles or property in the parking area, from criminal activities. You are parking at Your own risk and shall have automobile insurance to protect Your vehicle from any damages. h. You shall indemnify, defend and hold the Club; harmless from and against any and all claims, actions, liability, cost, expenses and damages of every kind and nature, including reasonable attorney`s fees, arising from use of the parking area.  Maximum parking time limits may be enforced by towing or immobilization at your expense.  

24. Copyright and Reproduction. The copyright of any photographs, video and footage taken within Vibe Fitness Clubs, shall belong to the Club.; The sale, publication, or any other commercial use of the aforementioned content, directly or indirectly, is strictly prohibited without the prior written consent of Club.; This provision also encompasses social media, including but not limited to, Facebook, Instagram, Twitter, and any blog or anything of the like. Members hereby authorize Vibe Fitness Clubs, the Club, and any of Vibe Fitness or the Club contracted videographer, photographer’, marketing agents, public relations firms, social media firms, including without limitation Vibe Fitness or the Club, officers, employees, independent contractors and subcontractors to record and photograph the Member image and/or voice for use by the Vibe Fitness or the Club for purposes that include, but are not limited to the following initiatives: social media, website promotions, e-mail marketing campaigns, informational materials, quality assurance, recruiting, advertising and marketing, at Vibe Fitness or the Club; sole discretion. Member specifically acknowledges and agrees that any photo and/or video appearance of him/her may be displayed online and used for promotional purposes and/or in any other manner or medium and for any purpose desired by Vibe Fitness or the Club. Member understands and agrees that audio, video, film and/or print images may be used, edited, duplicated, distributed, reproduced, broadcast and/or reformatted in any form and manner without payment of fees to the Member or to anyone else on the Member behalf forever, and as a Member, I hereby relinquish all right, title and interest therein to Vibe Fitness or the Club. Member hereby releases Vibe Fitness Club and/or the Club of if videographer, photographer, marketing agents, public relations firms, social media firms, including without limitation Vibe Fitness or the Club officers, employees, independent contractors and subcontractors from any and all liability relating to the taking, reproduction and/or use of such photographs, video images and/or sound recordings.

25. WAIVER OF LIABILITY: Member assumes full responsibility for his or her use of the facility and releases Vibe Fitness and/or the Club Owner from any and all claims, including those caused in whole or in part, by the negligence of Vibe Fitness and/or the Club Owner and shall indemnify Vibe Fitness, the owner of the club location the Member is utilizing, its affiliates, agents and employees against any and all liability arising out of use of the facilities. 26.  ASSUMPTION OF RISK; RELEASE; WAIVER. You understand that use of fitness facilities, equipment, classes, training, and programs involves inherent and other risks of injury, illness, death, and property damage, including from strenuous activity; misuse of equipment; actions or inactions of others; slips and falls; and exposure to communicable diseases. You voluntarily assume all such risks to the fullest extent permitted by law. To the fullest extent permitted by law, you release and discharge Vibe Fitness, the Club, and their respective owners, affiliates, directors, officers, employees, contractors, and agents from any and all claims and liabilities for personal injury, illness, death, or property loss or damage arising out of or related to your membership, presence at, or use of our facilities, equipment, services, or programs, even if caused in whole or in part by our negligence. This release does not apply to claims that cannot be released under applicable law.

27. INDEMNIFICATION. You agree to indemnify, defend, and hold harmless Vibe Fitness and the Club Parties from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your (or your guests’ or minors’ under your care) acts or omissions, violation of this Agreement or the Policies, or use of the facilities, except to the extent caused by our willful misconduct.  Without limitation, Member shall indemnify and hold harmless Vibe Fitness from any claims, demands, actions, damages, or liabilities asserted by Member`s guests, invitees, or minors arising from their presence at or use of Club facilities, services, or programs.

28. LIMITATION OF LIABILITY. To the fullest extent permitted by law, our total liability to you for any and all claims arising out of or related to this Agreement or your membership shall not exceed the total amounts you paid to us for membership dues during the twelve (12) months immediately preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

29. MEMBER CONDUCT AND SAFETY RULES. In addition to posted rules, you agree to: (a) follow staff instructions; (b) use equipment properly and replace it after use; (c) wipe down equipment and maintain hygiene; (d) refrain from unsafe, harassing, or disruptive behavior; (e) comply with time limits on equipment and facilities, including a maximum daily time in-club of 2.5 hours; and (f) comply with all reservations and capacity controls.

30. MEMBER INTERACTIONS:  Vibe Fitness is not responsible for the conduct, actions, statements, communications, or interactions of members, guests, or third parties. Vibe Fitness reserves the right, but assumes no obligation, to investigate complaints, mediate disputes, restrict access, or take corrective action regarding member conduct. Member assumes all risks arising from interactions with other members, guests, or third parties.

31. DAMAGE TO PROPERTY:  Member shall be responsible for any loss of or damage to Club property, equipment, furniture, fixtures, technology systems, lockers, parking facilities, or other assets caused by Member, Member`s guests, minors, invitees, or additional members on Member`s account. Vibe Fitness reserves the right to charge Member for the reasonable cost of repair, replacement, cleaning, restoration, administrative expenses, and related losses.

32. PAYMENT AUTHORIZATION; FEES. You authorize us and our billing service providers to store and use your payment credentials and to initiate charges for recurring dues, taxes, enrollment fees, add-on services, late/returned payment fees, no-show/late-cancel fees, replacement card fees, and other authorized charges. If a payment is returned or declined, we may reattempt and assess applicable fees as allowed by law.

33. DIGITAL SERVICES:  Vibe Fitness may provide access to mobile applications, websites, online content, virtual training, wearable integrations, AI-assisted coaching tools, member portals, electronic communications, and other digital services. Such services are provided on an "as available" basis and may be modified, suspended, replaced, or discontinued at any time without liability. Vibe Fitness does not guarantee uninterrupted availability, accuracy, or compatibility of digital services

34. CHARGEBACKS AND COLLECTIONS. You agree not to initiate chargebacks for amounts properly owed. If you do, we may suspend access and refer your account to collections. You agree to pay our reasonable costs of collection, including agency fees, court costs, and attorneys’ fees, as permitted by law.

35. FACILITY CLOSURE/MAINTENANCE; FORCE MAJEURE. We may temporarily close or limit areas for maintenance, repairs, improvements, private events, holidays, governmental orders, acts of God, or events beyond our reasonable control. We may modify services, hours, class schedules, and amenities. Dues and fees are not paused or refunded for such closures or modifications except as required by law or an approved freeze.

36. CLUB RELOCATION; MODIFICATION OF FACILITIES:  Vibe Fitness reserves the right to renovate, relocate, replace, consolidate, expand, reduce, rebrand, or otherwise modify any Club location, facility, service, amenity, program, operating hours, or membership offering. In the event a particular facility is closed, relocated, or substantially modified, Vibe Fitness may designate an alternate facility or membership benefit reasonably comparable to satisfy its obligations under this Agreement.

37. CLASS RESERVATIONS; LATE CANCELS; NO-SHOWS. Classes may require advance reservations. We may enforce cancellation cutoffs and charge a reasonable fee for late cancellations or no-shows. Repeated no-shows or late arrivals may lead to loss of reservation privileges.

38. MINORS. Parents/guardians are responsible for minors and must ensure compliance with all age, supervision, and area restrictions. Certain areas and equipment are restricted to adults. We may require parental presence or signed consent forms.

39. KIDS ZONE
    1. ASSUMPTION OF RISK & WAIVER OF LIABILITY
       1. Member understands and acknowledges that participation in the Kids Zone program involves inherent risks, including but not limited to: risk of injury from physical activities, interaction with other children, use of play equipment, toys, and other activities. I understand that despite reasonable safety measures, accidents and injuries can occur.
       2. Member WAIVEs, RELEASE, and DISCHARGE the facility, its owners, operators, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child or me while participating in the Kids Zone program or while on the premises, to the fullest extent permitted by law.
       3. I agree to INDEMNIFY and HOLD HARMLESS the facility from any loss, liability, damage, or cost that may arise from my child’s participation in the Kids Zone program, including attorney’s fees and court costs.

1. 3. Eligibility Requirements:
      1. Children must be between 2 and 12 years of age
      2. All children must be fully potty-trained (diapering services are not provided)
      3. Maximum visit duration: 2 hours per day
      4. Reservations required at least 48 hours in advance (walk-ins not accepted)
   4. Check-In/Check-Out Procedures:
      1. Valid photo ID and membership verification required
      2. Parent/guardian must carry mobile phone at all times while in facility
      3. Children will only be released to the parent/guardian who checked them in 
   5. Permitted & Prohibited Items:
      1. Permitted: Water and beverages in sealed containers
      2. Not Permitted: Food, personal toys, bicycles, scooters, strollers, or personal items of any kind
      3. Only authorized staff and parents/guardians are permitted in the Kids Zone area
   6. HEALTH & SAFETY POLICIES
      1. Illness Policy:
         1. To protect the health of all participants and staff, children with the following conditions will not be admitted:
         2. Fever above 99°F within the past 24 hours
         3. Contagious or communicable diseases (flu, measles, mumps, rubella, chicken pox, COVID-19, etc.)
         4. Infected eyes, skin rashes, or open sores
         5. Vomiting, diarrhea, or stomach illness within the past 24 hours
         6. Severe cold symptoms with heavy congestion, persistent cough, or difficulty breathing
         7. Any condition that prevents the child from comfortably participating in activities
         8. If a child becomes ill while in the Kids Zone, parents will be paged immediately. The child will be separated from other children and kept comfortable until pickup.
      2. Medication: Staff are not authorized to administer any medications, including over-the-counter medications.
      3. Allergies: Parents must inform staff in writing of any allergies or medical conditions. While we will make reasonable accommodations, we cannot guarantee an allergen-free environment.
      4. Emergency Procedures:  In the event of a medical emergency, staff will call 911 if emergency care is needed and will immediately contact parents/guardians and emergency contacts. Basic first aid will be administered as needed by trained staff. The facility maintains a first aid kit and AED (Automated External Defibrillator) on premises.
      5. EMERGENCY EVACUATION:  In the event of an emergency requiring evacuation of the Kid`s Zone:
         1. All children will be escorted to the primary assembly point located outside the main entrance of Vibe Fitness. If this location is deemed unsafe, children will be relocated to one of the following secondary sites:

               1. 114th Precinct Police Station located at 34-16 Astoria Blvd., Queens, NY, 11103
               2. FDNY Engine 263 / Ladder117 located at 42-08 Astoria Blvd S, Astoria, NY 11103
            2. L.I.C.  10-04 Borden Avenue, LIC, NY 11101
               1. 108th Precinct Police Station located at 5-47 50th Ave, Long Island City, NY 11101
               2. FDNY Engine 258 / Ladder 115 located at 10-40 47th Ave, Long Island City, NY 11101
         2. If necessary, Vibe Fitness staff will assist with transporting children by vehicle to the designated secondary locations. The first priority is to move all children away from danger as safely and quickly as possible.
         3. Each child will have an emergency contact card on file containing the child`s name, emergency phone numbers, and authorized contacts. This card will be taken during evacuation, and parents or guardians will be contacted for pickup as soon as it is safe to do so.
   7. IMPORTANT DISCLOSURES
      1. Service Description:
         1. THE KIDS ZONE IS NOT A LICENSED DAYCARE OR CHILDCARE FACILITY. It is a supervised children’s activity area provided as a member amenity. The Kids Zone is not subject to daycare licensing requirements or regulations.
         2. What Staff Will Do:
            1. Supervise children and maintain a safe, clean environment
            2. Facilitate age-appropriate activities and play
            3. Monitor children’s safety and well-being
            4. Provide basic first aid if needed
            5. Contact parents immediately if concerns or issues arise
         3. What Staff Will NOT Do:
            1. Change diapers or provide toileting assistance
            2. Feed children or prepare meals/snacks
            3. Provide homework help or educational tutoring
            4. Administer any medications
            5. Escort children to restrooms
            6. Provide one-on-one specialized attention or care
         4. Communication Policy:
            1. We maintain an open-door policy. Parents are welcome to observe the program at any time. Feedback and suggestions are always encouraged.
         5. Child Protection:
            1. Staff are trained to recognize signs of child abuse or neglect
