RELEASE OF LIABILITY AND ASSUMPTION OF RISK
The individual named below (referred to as "I" or "me") desires to access and use
the fitness facilities of Fitness Quest Health Club (“FQHC”) (the "Activity") located at 1601 10 th
Street, Reedley, California 93654 (the “Premises”) which is owned and operated by S & D
Lashinski, Inc., a California corporation (the "Company"). In consideration of being permitted
by the Company to participate in the Activity on the Premises and in recognition of the
Company`s reliance hereon, I agree to all the terms and conditions set forth in this instrument
(this "Release").
I am aware that I have access to the Premises 24 hours a day which includes
access after normal business hours and that as a result, if I become injured, unconscious, suffer a
stroke or heart attack, etc., that there will, in all likelihood, not be anyone else present at the
Premises at the time to respond to my emergency. I am aware and understand that even though
the Premises is equipped with surveillance cameras, that they are not monitored 24 hours a day
and that it is likely that should I require immediate assistance, none will be provided. I am aware
and understand that the Company strongly recommends that I have a workout partner each time I
use the Company’s equipment on the Premises.
I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A
POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF SERIOUS
INJURY, INFECTION, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I
ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE
COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE
COMPANY, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE
OPERATIONS OF THE COMPANY. NOTWITHSTANDING THE RISK, I
ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY
PARTICIPATING IN THE ACTIVITY ON THE PREMISES WITH AN EXPRESS
UNDERSTANDING OF THE DANGER INVOLVED AND HEREBY AGREE TO
ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, INFECTION,
DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY
PARTICIPATION IN THE ACTIVITY ON THE PREMISES, WHETHER CAUSED BY
THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE,
INCLUDING, BUT NOT LIMITED TO, MY USE OF ALL OF THE AMENITIES AND
EQUIPMENT ON THE PREMISES, MY PARTICIPATION IN ANY ACTIVITY,
CLASS, PROGRAM, PERSONAL TRAINING, OR INSTRUCTION WHILE ON THE
PREMISES, AND THE SUDDEN AND UNFORSEEN MALFUNCTIONING OF ANY OF
THE EQUIPMENT LOCATED AT THE PREMISES.
I hereby expressly waive and release any and all claims which I may have, or
which I may hereafter have, whether known or unknown, against the Company, and its officers,
directors, managers, employees, agents, affiliates, shareholders, successors, and assigns
(collectively, "Releasees"), on account of injury, infection, disability, death, or property damage
arising out of or attributable to my participation in the Activity on the Premises, whether arising
out of the ordinary negligence of the Company or any Releasees or otherwise. I covenant not to
make or bring any such claim against the Company or any other Releasee, and forever release
and discharge the Company and all other Releasees from liability under such claims. This waiver
and release does not extend to claims for gross negligence, intentional or reckless misconduct, or
any other liabilities that California law does not permit to be released by agreement.
I understand that by signing this release, I am waiving any and all claims, of any
kind arising out of or attributable to my participation in the Activity on the Premises, including
those claims that may be unknown to me, or which I do not suspect to exist at this time. WITH
THE INTENTION OF WAIVING ALL UNKNOWN AND UNSUSPECTED CLAIMS, I
HEREBY EXPRESSLY WAIVE ALL RIGHTS, BENEFITS, AND PROTECTIONS I
MAY HAVE UNDER CALIFORNIA CIVIL CODE SECTION 1542, WHICH READS AS
FOLLOWS:
A general release does not extend to claims that the creditor or releasing
party does not know or suspect to exist in his or her favor at the time of
executing the release and that, if known by him or her, would have
materially affected his or her settlement with the debtor or released party.
I shall defend, indemnify, and hold harmless the Company and all other Releasees
against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments,
settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including
attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the
cost of pursuing any insurance providers, incurred by the Company or any other Releasees
arising out of or resulting from any claim of a third party related to my participation in the
Activity, including any claims arising out of my own negligence or the ordinary negligence of
the Company.
I hereby consent to receive from any licensed hospital, physician, or medical
personnel any medical treatment deemed necessary if I am injured or require medical attention
during my participation in the Activity on the Premises. I understand and agree that I am solely
responsible for all costs related to such medical treatment and any related medical transportation
and/or evacuation.
This Release constitutes the sole and entire agreement of the Company and me
with respect to the subject matter contained herein and supersedes all prior and contemporaneous
understandings, agreements, representations, and warranties, both written and oral, with respect
to such subject matter. If any term or provision of this Release is held invalid, illegal, or
unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect
any other term or provision of this Release or invalidate or render unenforceable such term or
provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the
Company and me and their respective heirs, successors, and assigns. All matters arising out of or
relating to this Release shall be governed by and construed in accordance with the internal laws
of the State of California without giving effect to any choice or conflict of law provision or rule
(whether of the State of California or any other jurisdiction). Any claim or cause of action arising
under this Release may be brought only in the federal and state courts located in Fresno County,
California and I hereby consent to the exclusive jurisdiction of such courts.
BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND FULLY
UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM
VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE
RIGHT TO SUE THE COMPANY FOR CLAIMS, WHETHER KNOWN OR
UNKNOWN, ARISING OUT OF MY PARTICIPATION IN THE ACTIVITY.
I am the parent or legal guardian of the minor named above and I certify that the minor
named above is at least 13 years of age at the time of execution of this agreement and that I
may be required to prove the age of the minor named above. I have the legal right to
consent to and, by signing below, I hereby do consent to the terms and conditions of this
Release of Liability and Assumption of Risk.
I understand that members aged 13 and 14 must be accompanied by a parent or legal
guardian when they work out at the Premises at all times. The Company does not provide
child care services.

INCLUYENDO RESPUESTA DE EMERGENCIA NEGLIGENTE O LAS OPERACIONES
DE RESCATE DE LA COMPAÑÍA. A PESAR DEL RIESGO, RECONOZCO QUE
ESTOY PARTICIPANDO A SABIENDAS Y VOLUNTARIAMENTE EN LA

INSTRUCCIÓN MIENTRAS ESTOY EN LAS INSTALACIONES Y LO REPENTINO Y
MAL FUNCIONAMIENTO IMPREVISTO DE CUALQUIER EQUIPO UBICADO EN
EL LOCAL.
Por la presente, renuncio y libero expresamente todos y cada uno de los reclamos
que pueda tener, o que pueda tener en el futuro, ya sea conocido o desconocido, contra la
Compañía y sus funcionarios, directores, gerentes, empleados, agentes, afiliados, accionistas,
sucesores y cesionarios (colectivamente, “Liberados"), a causa de lesiones, infección,

Una liberación general no se extiende a reclamaciones que el acreedor o el
liberador parte no sabe o conoce o sospecha que existen a su favor en el
momento de ejecutar la liberación y que, de haberlas conocido, habrían
afectado materialmente su acuerdo con el deudor o Liberado.
Defenderé, indemnizaré y eximiré de toda responsabilidad a la Compañía y a

o hará inaplicable dicho término o disposición en cualquier otra jurisdicción. Esta Liberación es
vinculante y redundará en beneficio de la Compañía y de mí y de sus respectivos herederos,
sucesores y cesionarios. Todos los asuntos que surjan de o estén relacionados con este
Comunicado se regirán e interpretarán de acuerdo con las leyes internas del Estado de California

Nombre de Padre o Tutor Legal
Soy el padre o tutor legal del menor mencionado anteriormente y certifico que el menor
mencionado anteriormente tiene al menos 13 años de edad en el momento de la ejecución de este
acuerdo y que es posible que se me solicite demostrar la edad del menor mencionado
anteriormente. Tengo el derecho legal de dar mi consentimiento y, al firmar a continuación, doy

FITNESS QUEST HEALTH CLUB
MEMBERSHIP AGREEMENT
Agreement between S & DLashinski Inc. d/b/a Fitness Quest Health Club, a California corporation, referred to herein as the Club, and the following (if applicable) family members referred to herein as the Member.
WhereasMember desires to become a member of the Club and cannot become a member without agreeing to the rules and regulations set forth below andabiding by the terms of this Agreement;Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:
- Check In Policy
Members must check in each time that they use the Club by presenting his/her current membership card at the front desk upon arrival. Club usage may be denied if Member does not present card. The Club may either close or operate at reduced hours on holidays. Business hours, policies, and regulations are subject to change without notice.
2. Membership Fees and Cancellation
Membership use and services must be paid for in advance. All fees and schedules are subject to change without notice. At the present time, membership fees are as follows:
The obligation to pay dues is not dependent on the availability of all theClub’s facilities. Special engagements, repairs, and maintenance of some facilities may make it necessary for the Club to restrict use of, or close, one or more of the facilities. Fees will not be reduced or suspended during the time when one or more of the facilities are not available. Monthly Renewing Members may cancel memberships by notifying Club personnel of his/her wish to cancel in person, any time during business hours prior to the first day of the month to be cancelled. There are no refunds for membership fees, and the Club will not prorate a cancelled membership. Anyone who cancels must obtain a confirmation number. This confirmation number is used for reference and proof of cancellation. The Club will not accept cancellation claims without a confirmation number.
3. Three-Day Right of Recession
New members have three days after signing this Agreement to cancel their membership without penalty. If the Agreement is cancelled within three days, the Club will return to the member within thirty days all amounts paid. To cancel, new members must call or come into the Club and inform the front desk personnel of their wish to cancel.
4. Freeze Policy
Members may put their membership on freeze, if the Member is current on all dues. Notice of freeze must be given to Club personnel or in person any time during business hours prior to the first day of the month to be frozen. Monthly members will be billed for $4 per frozen months. Billing will resume automatically upon end of freeze. Yearly Members will have current year extended by the number of frozen months. Anyone who freezes his or her membership must obtain a confirmation number. This confirmation number is used for reference and proof of freeze. The Club will not accept freeze claims without a confirmation number. In order to freeze an account, all membership cards associated with the account must be turned over to the Club.
5. Attire
Proper attire is required for participants using the Club. Shirts, shoes, and clean, un-torn clothing are mandatory. No bathing suits or briefs without tights or leg coverings are allowed. Proper footwear must be worn as follows:
a. Aerobics
Court-type or aerobics shoes only, unless otherwise specified by the instructor.
b. Weight Training and General Exercise
No open toed shoes, thongs, sandals, street shoes, bare feet, or slipper-type shoes allowed.
6. Equipment
All equipment must be used as designed. If member is not familiar with use of equipment, he/she must arrange instruction with a staff member. Instruction is available to members as part of their membership. Members must be familiar with and observe Club rules and regulations posted in the Club area. Members who do not observe Club rules and regulations or who abuse equipment in any fashion will be asked to leave. The management reserves the right to terminate membership to anyone who refuses to observe any of the Club`s rules or regulations.
7. Conduct
The Club is committed to the health, safety, and welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. The Club has the right to judge behavior and respond accordingly. This right includes, but is not limited to, termination of membership of any member engaging in unacceptable behavior.
8. Personal Training
The Club is staffed in part by Fitness Trainers both in house employee personal trainers and partner personal trainers. All personal trainers are certified. Our partner trainers have a business license with the City of Reedley, an agreement with the company to be able to train in our facility and carry their own insurance. Contract training is not available. Outside trainers (or anyone acting as a trainer) may not do business of any kind in our facility, whether in the form of client solicitation or training facilitation.
9. Lockers
Lockers are available for day use only. Members must supply his/her own lock. Locks and articles left overnight will be removed. The use of cellular phones is not allowed inside the locker room facilities.
10. Children
Members must be 13 years of age or older. Minors under the age of 15 must be supervised at all times.
11. Damages
Members shall pay for any damages to the Club’s property which results from the willful or negligent conduct of member, member`s guest, or dependent children.
12. Lost Articles
The Club assumes no responsibility for lost or stolen articles. Lost and found articles not claimed will be donated to charity.
13. Guests
Guests may enter the Club on payment of a fee determined by the Club from time to time. Guests must sign the Guest register and show a form of photo identification. The number of visits by a guest to the Club is at the sole discretion of the Club and must be at least 13 years old. All minors need legal guardian to sign liability release for guest workout pass.
14. Disability Accommodations. The Club will accommodate persons with disabilities as required by law. Member is required to inform the Club of the need for an accommodation(s). Service animals trained to assist persons with disabilities are permitted, subject to applicable rules. No other animals are permitted.
15. Smoking, Food, and Drink
No smoking is allowed in any part of the facility. No food or drink is allowed beyond the lobby and vending machines. Water may be taken into workout areas if it is in a non-breakable, enclosed container.
16. Late Payment of Fees
A late payment fee of $10.00 will be charged on any payment past due. Membership fees must be paid on or before the first day of the month when due. Membership may be cancelled, at the discretion of the Club if fees are not timely paid.
17. Cancellation of Membership by Member
A member may cancel his/her contract membership at any time upon payment of a cancellation fee of $50 to $100 depending on circumstances. Cancellation under any other circumstance will require a $100.00 fee if more than 6 months are left on their contract. If 6 or less months are left on their contract then the cancellation fee will be $50.00. The member’s account must be current on all dues and charges in order to cancel.
18. Change of Rules and/or Regulations
The Club reserves the right to add to, change or remove rules, conditions of membership, opening and closing hours and the services and facilities offered by the Club from time to time.
19. Release of Liability and Assumption of Risk
a. The undersigned member (hereinafter referred to as Member) understands and agrees that he/she will execute the accompanying Release of Liability and Assumption of Risk waiver.
b. Member represents that he/she is in good physical health, and that Member shall notify the Club in writing if he/she becomes unable to participate in an activity due to some physical or mental considerations.
c. The provision of this Paragraph shall continue in full force and effect even after the termination of Member’s membership in the Club.
20. 24-Hour Access Rules
Member understands that if Member enters the Club after regular business hours that Member must unlock the door by checking in using the Member’s membership card. Member understands and agrees that Member will not let anyone else, including, but not limited to, any of the Member’s children, family members, or other people that are not themselves members of the Club, into the Club’s facility when Member unlocks the door. In the event anyone enters after hours, Member agrees that Member will pay a fee of $50 for each person that enters and the Member will be responsible for any damages caused by the additional individuals. Member will ensure that the door is always locked when entering or exiting after hours.
21. Miscellaneous
a. This Agreement contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Agreement. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.
b. Member has read, and fully agrees to the terms of this Agreement and understands and agrees that by signing this Agreement (which contains a waiver, release and assumption of risks) Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is at least 18 years of age or older and mentally competent to enter into this Agreement.
Fitness Quest Health Club Etiquette and Equipment Use Guidelines
To ensure a safe, respectful, and enjoyable environment for all members, we have established the following guidelines. Your cooperation is essential in maintaining a positive atmosphere.
General Etiquette
1. **Account Verification: All members must have their accounts checked upon entry. No exceptions.
2. **Respect Others: Follow the Golden Rule—treat others how you wish to be treated.
3. **Family-Friendly Environment: This is a family gym. Please refrain from using profanity.
4. **Dress Code: Shirts and shoes are required. Flip-flops and sandals are not permitted.
5. **Cleanliness: Dispose of trash, water bottles, and magazines properly.
6. **Class Consideration: Please do not interrupt ongoing classes.
7. **Conflict Resolution: If disagreements arise, de-escalate the situation calmly and report it to staff.
Equipment Use
1. **Safety First: Improper use of equipment can lead to injury. If unsure, ask a staff member for assistance.
2. **Proper Setup: Ensure that seats are secured and pins are fully inserted before use.
3. **Time Limits: During peak hours, limit cardio equipment use to 20-30 minutes if others are waiting.

5. **Weight Handling: Avoid jerking, bouncing, or dropping weights. Charges apply for broken equipment.
6. **Return Equipment: Always return equipment to its designated place after use.
7. **Safety Accessories: Use collars with free weights and consider having a spotter.
8. **Report Issues: Immediately report any worn, broken, or defective equipment to staff.
9. **Boxing Gear: Use hand wraps or boxing gloves, preferably both, when using punching bags.
10. **Personal Fans: If needed, place a floor fan in your area and turn it off when finished.
11. **Audio Devices: Use headphones or earbuds for personal audio. Speakers are not allowed.
12. **Sharing Equipment: Working in with others is encouraged. If resting, allow someone else to use the same machine.
13. **Super Setting: You may use two pieces of equipment (one plate-loaded and one cable machine) while allowing others to work in on the cable machine.
14. **Personal Hygiene: Maintain good hygiene and come to the gym free from offensive odors.
15. **No Smoking/Vaping: Smoking or vaping of any kind is prohibited in the facility.
16. **Child Policy: Children without memberships cannot be supervised in the gym. For child care services, inquire at the front desk.
17. **Phone Courtesy: Keep phone calls brief and avoid speaker mode. For long conversations, please step outside. 18. ** Filming & Recording: Intentional filming of your own set is permitted. Members are expected to be aware of their surroundings at all times. Candid or intentional recording of another member without their knowledge or consent is strictly prohibited and will be enforced. If you are caught recording another member without their knowledge or consent,
you will be invited to go find a new gym. Please remember: Fitness Quest Health Club is a gym, not a film studio. Be respectful of the people around you and allow everyone to enjoy their workout comfortably and privately.

ACUERDO DE MEMBRESIA
Acuerdo entre S & D Lashinski Inc. d/b/a Fitness Quest Health Club, una corporación de California, referida en este documento como el Club, y los siguientes (si corresponde) miembros de la familia denominado en el presente documento el Miembro.
Considerando que el Miembro desea convertirse en miembro del Club y no puede convertirse en miembro sin estar de acuerdo con las reglas y regulaciones establecidas a continuación, un cumplir con los términos de este Acuerdo;
Ahora, por lo tanto, para y en consideración a los pactos mutuos contenidos en este acuerdo, y otras contraprestaciones buenas y valiosas, cuya recepción y suficiencia se reconoce por la presente, las partes acuerdan lo siguiente:
1. Política de Registro
Los socios deben registrarse cada vez que utilicen el Club presentando su tarjeta de socio actual en la recepción a su llegada. El uso del club puede ser denegado si el socio no presenta la tarjeta. El Club puede cerrar o operar en horario reducido los días festivos. El horario comercial, las políticas y las regulaciones están sujetas a cambios sin previo aviso.
2. Membership Fees and Cancellation

La obligación de pagar cuotas no depende de la disponibilidad de todas las instalaciones del Club. 3. Derecho de recesión de tres días

4. Póliza de congelación
Los miembros pueden congelar su membresía, si el miembro está al día con todas las cuotas. El aviso de congelación debe darse al personal del Club o en persona en cualquier momento durante el horario comercial antes del primer día del mes que se va a congelar. A los miembros mensuales se les facturará $4 por meses congelados. La facturación se reanudará automáticamente al finalizar la congelación. A los miembros anuales se les extenderá el año en curso por el número de meses congelados. Cualquier persona que congele su membresía debe obtener un número de confirmación. Este número de confirmación se utiliza como referencia y prueba de congelación. El Club no aceptará reclamos de congelación sin un número de confirmación. Para congelar una cuenta, todas las tarjetas de membresía asociadas con la cuenta deben entregarse al Club.
5. Código de vestimenta
Se requiere vestimenta adecuada para los participantes que utilizan el Club. Son obligatorios llevar camisas, zapatos y ropa limpia y sin rasgar. No se permiten trajes de baño o calzoncillos sin medias o cubrepiernas. Se debe usar calzado adecuado de la siguiente manera:
a. Aerobic
Solo zapatos de cancha o aeróbicos, a menos que el instructor especifique lo contrario.
b. Entrenamiento con pesas y ejercicio general
No se permiten zapatos abiertos, tangas, sandalias, zapatos de calle, pies descalzos o zapatos tipo pantufla.
6. Equipo
Todo el equipo debe usarse según lo diseñado. Si el miembro no está familiarizado con el uso del equipo, debe organizar la instrucción con un miembro del personal. La instrucción está disponible para los miembros como parte de su membresía. Los socios deben estar familiarizados y observar las reglas y regulaciones del Club publicadas en el área del Club. A los socios que no observen las reglas y regulaciones del Club o que abusen del equipo de cualquier manera se les pedirá que se vayan. La dirección se reserva el derecho de rescindir la membresía a cualquier persona que se niegue a observar cualquiera de las reglas o regulaciones del Club.
7. Conducta
El Club está comprometido con la salud, la seguridad y el bienestar de cada uno de sus miembros y personal y no tolerará comportamientos irrazonables, amenazantes, obscenos, acosadores, indecentes o ilegales. El Club tiene el derecho de juzgar el comportamiento y responder en consecuencia. Este derecho incluye, pero no se limita a, la terminación de la membresía de cualquier miembro que participe en un comportamiento inaceptable.
8. Entrenamiento personal
El Club cuenta con personal en parte por entrenadores de fitness, tanto entrenadores personales de empleados internos como entrenadores personales asociados. Todos los entrenadores personales están certificados. Nuestros entrenadores asociados tienen una licencia comercial con la ciudad de Reedley, un acuerdo con la empresa para poder entrenar en nuestras instalaciones y tener su propio seguro. La capacitación por contrato no está disponible. Los entrenadores externos (o cualquier persona que actúe como entrenador) no pueden hacer negocios de ningún tipo en nuestras instalaciones, ya sea en forma de solicitud de clientes o facilitación de capacitación.
9. Armarios
Los casilleros están disponibles solo para uso diurno. Los miembros deben proporcionar su propio candado. Se retirarán los candados y los artículos que se dejen durante la noche. No está permitido el uso de teléfonos celulares dentro de las instalaciones de vestuarios.
10. Niños
Los miembros deben tener 13 años de edad o más. Los menores de 15 años deben estar supervisados en todo momento.
11. Daños y perjuicios
Los miembros pagarán por cualquier daño a la propiedad del Club que resulte de la conducta intencional o negligente del miembro, el invitado del miembro o los hijos dependientes.
12. Artículos perdidos
El Club no asume ninguna responsabilidad por artículos perdidos o robados. Los artículos perdidos y encontrados que no se reclamen se donarán a organizaciones benéficas.
13. Invitados
Los invitados pueden ingresar al Club mediante el pago de una tarifa determinada por el Club de vez en cuando. Los huéspedes deben firmar el registro de huéspedes y mostrar una forma de identificación con foto. El número de visitas de un huésped al Club queda a su entera discreción y debe tener al menos 13 años de antigüedad. 15. Fumar, comer y beber
No se permite fumar en ninguna parte de las instalaciones. No se permite comer ni beber más allá del vestíbulo y las máquinas expendedoras. Se puede llevar agua a las áreas de entrenamiento si está en un recipiente cerrado e irrompible.
16. Pago tardío de tarifas
Se cobrará un cargo por pago atrasado de $10.00 en cualquier pago atrasado. Las cuotas de membresía deben pagarse en o antes del primer día del mes a vencimiento. La membresía puede ser cancelada, a discreción del Club si las tarifas no se pagan a tiempo.
17. Cancelación de la membresía por parte del miembro
Un miembro puede cancelar su membresía de contrato en cualquier momento mediante el pago de una tarifa de cancelación de $ 50 a $ 100, según las circunstancias. La cancelación bajo cualquier otra circunstancia requerirá una tarifa de $ 100.00 si quedan más de 6 meses en su contrato. 18. Cambio de Reglas y/o Regulaciones
El Club se reserva el derecho de agregar, cambiar o eliminar reglas, condiciones de membresía, horarios de apertura y cierre y los servicios e instalaciones ofrecidos por el Club de vez en cuando.
19. Exoneración de Responsabilidad y Asunción de Riesgos
a. El miembro abajo firmante (en lo sucesivo, el Miembro) entiende y acepta que ejecutará la exención de responsabilidad y la renuncia a la asunción de riesgo que la acompañan.
b. El Socio declara que goza de buena salud física, y que el Socio deberá notificar al Club por escrito si no puede participar en una actividad debido a alguna consideración física o mental.
c. La disposición de este párrafo continuará en pleno vigor y efecto incluso después de la terminación de la membresía del Miembro en el Club.
20. Reglas de Acceso las 24 horas
El Socio entiende que si el Socio ingresa al Club después del horario comercial habitual, ese Miembro debe abrir la puerta registrándose con la tarjeta de membresía del Miembro. El Miembro entiende y acepta que el Miembro no permitirá que nadie más, incluidos, entre otros, los hijos, familiares u otras personas que no sean miembros del Club, ingresen a las instalaciones del Club cuando el Miembro abra la puerta. En el caso de que alguien ingrese fuera del horario de atención, el Miembro acepta que el Miembro pagará una tarifa de $ 50 por cada persona que ingrese y el Miembro será responsable de cualquier daño causado por las personas adicionales. El miembro se asegurará de que la puerta esté siempre cerrada con llave al entrar o salir fuera del horario de atención.
21. Misceláneo
a. Este Acuerdo contiene el acuerdo completo entre las partes y reemplaza cualquier acuerdo escrito u oral anterior entre ellas con respecto al objeto de este Acuerdo. Las disposiciones de este documento pueden ser renunciadas, alteradas, enmendadas o derogadas, en su totalidad o en parte, solo con el consentimiento previo por escrito de todas las partes.
b. El Miembro ha leído y está totalmente de acuerdo con los términos de este Acuerdo y entiende y acepta que al firmar este Acuerdo (que contiene una renuncia, liberación y asunción de riesgos) el Miembro ha renunciado a considerables derechos legales futuros. El Miembro ha firmado este Acuerdo libremente, voluntariamente, sin coacción o amenaza de coacción, sin que se le comunique ningún incentivo, promesa o garantía. El Miembro certifica y garantiza que tiene al menos 18 años de edad o más y que es mentalmente competente para celebrar este Acuerdo.
