Cancellation Policy

Cancellation After Commitment Period: Members may cancel their membership at any time after the three-month commitment period by providing a written notice, either email or text message, no later than 24 hours before the next billing cycle.

Cancellation Requests: Cancellation requests must be submitted via email or by text message. Verbal cancellations will not be accepted, including voicemails.

Final Billing: Members will be billed for one final month following the submission of their cancellation request if the 30-day notice period overlaps with the next billing cycle.

This Liability Waiver and Release of Claims ("Waiver") is executed by the undersigned individual ("Participant") in favor of Revive Sports Recovery and Body Maintenance, its owners, affiliates, agents, employees, and representatives (collectively, "Revive Sports Recovery and Body Maintenance" or "Facility"). By signing this Waiver, Participant acknowledges and agrees to the following terms:

1. Assumption of Risk

1.1. Participant acknowledges that the Facility provides self-serving equipment, including but not limited to ice baths, red light therapy, salt and sauna rooms, touchless jet massage, localized cryotherapy, sports recovery devices, and stretching equipment ("Services"). The Facility is not staffed, and all equipment is used at the Participant`s own discretion and risk.

1.2. Participant understands that the use of the Facility and its equipment involves inherent risks, including but not limited to physical exertion, potential aggravation of existing medical conditions, bodily injury, allergic reactions, or other harm. Participant assumes all risks associated with the use of the Facility and its Services.

1.3. Participant acknowledges that the Facility does not provide supervision, monitoring, or guidance for the use of its equipment.

2. Not a Medical Facility

2.1. Participant acknowledges and agrees that Revive Sports Recovery and Body Maintenance is not a medical facility and does not provide medical advice or diagnoses of any kind.

2.2. Participant should consult with a qualified healthcare provider before using any of the Facility`s equipment, particularly if they have existing medical conditions, are pregnant, or are taking medications.

3. Waiver and Release

3.1. Participant hereby waives, releases, and forever discharges Revive Sports Recovery and Body Maintenance from any and all claims, liabilities, demands, causes of action, or damages arising out of or relating to participation in the Facility`s Services or use of its equipment, including but not limited to claims for personal injury, property damage, or economic loss.

3.2. Participant further agrees to hold harmless and indemnify Revive Sports Recovery and Body Maintenance from any claims, actions, or liabilities resulting from the Participant`s use of the Facility or its equipment.

4. Equipment Use

4.1. Participant agrees to use all equipment in accordance with posted instructions, warnings, and guidelines. Failure to follow instructions may result in injury, for which the Facility is not liable.

4.2. Participant is solely responsible for determining their ability to safely use the Facility’s equipment and Services. Participant should cease use immediately if they experience discomfort, pain, or adverse effects.

5. Acknowledgment of Unstaffed Facility

5.1. Participant acknowledges and accepts that the Facility is unstaffed and that no personnel are available to provide assistance, supervision, or emergency response. Participant assumes full responsibility for their own safety while using the Facility.

5.2. Participant agrees to contact emergency services (e.g., 911) in the event of an emergency while on the premises.

6. Minors

6.1. If the Participant is under the age of 18, this Waiver must be signed by a parent or legal guardian. The parent or legal guardian assumes all responsibility for the minor’s use of the Facility and its equipment.

7. Severability

7.1. If any provision of this Waiver is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

8. Governing Law

8.1. This Waiver is governed by the laws of the state in which Revive Sports Recovery and Body Maintenance operates. Any disputes arising from this Waiver shall be resolved under the jurisdiction of the applicable state or federal courts.

Acknowledgment and Agreement

By signing below, Participant acknowledges that they have read, understood, and voluntarily agreed to this Liability Waiver and Release of Claims. Participant affirms that they are at least 18 years old or have obtained parental/guardian consent if under the age of 18.

Terms and Conditions for Revive Sports Recovery and Body Maintenance Memberships

Welcome to Revive Sports Recovery and Body Maintenance. These Terms and Conditions ("Terms") govern your membership under the Unlimited Recovery, Ultimate Unlimited, and Ultimate Unlimited Flex membership names. By enrolling in any of these memberships, you agree to the following terms:

1. Membership Commitment

1.1. Minimum Commitment Period: All Unlimited Recovery, Ultimate Unlimited, and Ultimate Unlimited Flex memberships require a minimum commitment period of three (3) months from the date of signup.

1.2. Early Cancellation: Members may not cancel their membership during the initial three-month commitment period. After completing the commitment period, cancellations are allowed per Section 5.

1.3. Renewal: Memberships automatically renew monthly following the three-month commitment period unless canceled in accordance with these Terms.

2. Membership Benefits

2.1. Members will have access to the services and facilities as outlined in the specific membership plan selected at signup.

2.2. Membership benefits are non-transferable and may not be shared with non-members unless otherwise specified by Revive Sports Recovery and Body Maintenance.

3. Payment Terms

3.1. Billing Cycle: Membership fees are billed monthly, starting on the date of signup and recurring on the same date each month.

3.2. Payment Methods: Accepted payment methods include major credit cards (subject to processing fee) or from your checking account (no processing fee).

3.3. Declined Payments: If a payment is declined, the member is responsible for updating their payment information immediately. Failure to resolve payment issues may result in suspension or termination of membership.

4. Freeze Policy

4.1. Members may request to freeze their membership for medical or other approved reasons by providing written notice to Revive Sports Recovery and Body Maintenance. Membership freezes are granted at the sole discretion of the company and do not count toward the three-month commitment period.

5. Cancellation Policy

6. Refunds and Credits

6.1. Membership fees are non-refundable, except in cases where Revive Sports Recovery and Body Maintenance is unable to provide services due to unforeseen circumstances.

6.2. No credit or refund will be provided for unused portions of the membership period.

7. Changes to Membership Plans

7.1. Revive Sports Recovery and Body Maintenance reserves the right to modify membership fees, benefits, or terms with a minimum of thirty (30) days’ notice to members. Changes will not affect the initial three-month commitment period.

7.2. Members will be notified of any changes via email or the contact information provided at signup.

8. Code of Conduct

8.1. Members are expected to follow all facility rules and policies as posted or communicated by staff.

8.2. Revive Sports Recovery and Body Maintenance reserves the right to terminate memberships without refund for violations of the Code of Conduct, including but not limited to disruptive behavior, misuse of equipment, or non-compliance with staff instructions.

9. Liability Waiver

9.1. Members acknowledge and accept the risks associated with the use of recovery equipment and services.

9.2. Revive Sports Recovery and Body Maintenance is not liable for injuries, damages, or losses incurred during the use of its facilities or services, except in cases of gross negligence or willful misconduct.

10. Governing Law

10.1. These Terms are governed by the laws of the state in which Revive Sports Recovery and Body Maintenance operates. Any disputes arising from these Terms will be resolved in accordance with local jurisdiction.
