IMPORTANT LEGAL NOTICE
THIS DOCUMENT CONTAINS A BINDING BILLING AUTHORIZATION
I authorize IRON HOUSE TC LLC to charge my credit or debit card on a recurring basis for membership dues, installment payments, fees, and any other charges permitted under my membership or installment agreement.
I understand that:
Charges will be processed according to the agreed billing schedule.
Charges will continue until my membership is canceled or paused in accordance with the membership terms.
I authorize IRON HOUSE TC LLC to initiate electronic fund transfers (“EFTs”) and/or Automated Clearing House (“ACH”) debits from the bank account identified by me for membership dues, installment payments, fees, and other authorized charges to which I have agreed.
I understand that:
Debits will occur on a recurring basis according to my agreed-upon billing schedule.
This authorization is governed by applicable federal law and NACHA operating rules.
I understand that if any credit card charge or EFT/ACH transaction is declined, returned, or rejected for any reason, I may be responsible for any applicable return fees, processing fees, or service charges, in addition to the amount owed, as permitted by law.
I understand that this billing authorization remains in effect unless and until I cancel my membership or revoke this authorization.
I may cancel my membership and revoke this authorization at any time by any of the following methods:
• In person at the facility
• By phone
• Online through the member account or cancellation method made available by IRON HOUSE TC LLC
Upon cancellation, no further recurring charges will be initiated after the applicable notice or billing period, if any, as disclosed in my membership terms.
Such revocation will not affect:
Charges or debits initiated prior to receipt of the revocation; or
Any outstanding balances owed.
I understand that my billing information will be stored and processed securely and used solely for lawful business purposes, including billing, account administration, and payment processing, in compliance with applicable federal law and the laws of the State of Michigan.

This Member Liability Waiver, Release of Claims, Assumption of Risk, and Indemnification Agreement ("Agreement") is entered into by the undersigned individual ("Member") in favor of Iron House TC LLC, its owners, members, managers, officers, employees, contractors, volunteers, agents, successors, and assigns (collectively, "Iron House TC").
By signing this Agreement, Member acknowledges and agrees to the following terms:
1. ASSUMPTION OF RISK
Member understands and acknowledges that participation in fitness, strength training, cardiovascular exercise, group or individual training, use of gym equipment, free weights, machines, tanning services, dry sauna use, locker rooms, and any related activities at Iron House TC involves **inherent and significant risks**, including but not limited to:
* Muscle strains, sprains, tears, soreness, or fatigue
* Slips, trips, and falls
* Heart attack, stroke, fainting, or other cardiovascular events
* Dehydration, overheating, burns, or heat-related illness (including risks related to sauna use)
* Skin irritation, burns, or other reactions associated with tanning services
* Equipment malfunction or misuse
* Aggravation of pre-existing medical conditions
* Serious bodily injury, permanent disability, paralysis, or death
Member voluntarily and knowingly **assumes all risks**, both known and unknown, foreseeable and unforeseeable, associated with participation in any activity or use of any facility or service at Iron House TC.
2. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Michigan law, Member hereby **releases, waives, and forever discharges** Iron House TC from any and all claims, demands, damages, losses, liabilities, costs, or expenses of any kind, whether arising from **negligence or otherwise**, related to or arising out of:
* Member’s participation in fitness activities
* Use of exercise equipment or facilities
* Use of tanning equipment or services
* Use of the dry sauna
* Presence on Iron House TC premises
This release applies to claims for personal injury, illness, property damage, wrongful death, or any other loss, whether occurring now or in the future.
3. MEDICAL REPRESENTATIONS
Member represents and warrants that:
* Member is physically and mentally capable of participating in exercise and fitness activities
* Member has no medical condition that would make participation unsafe, or has consulted a physician prior to participation
* Member understands that Iron House TC does not provide medical advice or supervision
Member agrees to immediately discontinue any activity that causes pain, discomfort, dizziness, or distress and to seek medical attention as needed.
4. TANNING ACKNOWLEDGMENT AND AGE RESTRICTIONS
Member understands that tanning services involve exposure to ultraviolet (UV) radiation and may increase the risk of skin cancer, skin aging, eye injury, or other health conditions.
**Michigan Age Compliance – Tanning Services:**
* **Individuals under the age of eighteen (18) are strictly prohibited from using tanning equipment**, in accordance with applicable Michigan law and federal regulations.
* Valid government-issued photo identification may be required to verify age prior to tanning use.
Member acknowledges that:
* Protective eyewear is required and provided or made available
* Tanning use is entirely voluntary
* Member has reviewed and understands all posted warnings, manufacturer instructions, and risk disclosures
Member voluntarily assumes all risks associated with tanning services and releases Iron House TC from liability related to such use.
5. SAUNA ACKNOWLEDGMENT AND AGE RESTRICTIONS
Member understands that use of the dry sauna involves exposure to high heat and may pose health risks, especially for individuals with heart conditions, high blood pressure, pregnancy, dehydration, or other medical issues.
**Age Restrictions – Sauna Use:**
* Individuals **under the age of eighteen (18)** may only use the dry sauna **with written parental or legal guardian consent** and **direct supervision by their parent or legal guardian**, unless Iron House TC LLC adopts a stricter policy.
* Children **under the age of twelve (12)** are **not permitted to use the sauna** under any circumstances.
Member agrees that:
* Sauna use is voluntary
* Member will follow all posted rules and time limits
* Member will exit immediately if feeling lightheaded, dizzy, overheated, or unwell
* Member will not use the sauna while under the influence of alcohol, drugs, or medications that impair judgment or thermoregulation
Member assumes all risks related to sauna use and releases Iron House TC from any liability arising therefrom.
6. INDEMNIFICATION
Member agrees to **indemnify, defend, and hold harmless** Iron House TC from any and all claims, actions, damages, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to:
* Member’s use of the facility or services
* Member’s violation of gym rules or this Agreement
* Member’s actions or omissions while on the premises
* Member’s intentional misuse, abuse, or destruction of equipment or property, for which Iron House TC may seek reimbursement or damages through legal action
7. RULES AND POLICIES
Member agrees to comply with all written and posted rules, policies, and instructions of Iron House TC, including those related to equipment use, tanning, sauna use, hygiene, and conduct.Iron House TC reserves the right to deny access or terminate membership for failure to comply.
8. NO INSURANCE REPRESENTATION
Member understands that Iron House TC does not provide health, medical, or accident insurance coverage for Member. Member is solely responsible for obtaining any desired insurance coverage.
9. MINORS, PARENTAL CONSENT, AND SUPERVISION REQUIREMENTS
a. Minors (Under 18 Years of Age)
Any individual **under the age of eighteen (18)** may only use the facilities and services of Iron House TC LLC with the **written consent and signature of a parent or legal guardian**. By signing this Agreement on behalf of a minor, the parent or legal guardian:
* Consents to the minor’s participation in all activities offered at Iron House TC LLC, including use of exercise equipment, tanning services (if permitted by law and facility policy), and sauna use (if permitted by law and facility policy)
* Agrees to all terms of this Agreement on behalf of the minor
* Assumes full responsibility for the minor’s conduct and safety
* Releases and waives all claims on behalf of the minor to the fullest extent permitted by Michigan law
b. Children Under 12 Years of Age
Children **under the age of twelve (12)** are **not permitted to be left unattended or unsupervised** anywhere on the premises at any time. Iron House TC LLC does not provide childcare services.
Children under the age of twelve (12) **may not use any exercise equipment** unless they are under the **direct supervision of their parent or legal guardian at all times**. Iron House TC LLC reserves the right to deny access or remove any minor from the facility for safety reasons or violations of this policy.
10. PERSONAL PROPERTY AND THEFT
Member understands and agrees that **Iron House TC LLC is not responsible for lost, stolen, ordamaged personal property**, including but not limited to clothing, shoes, jewelry, wallets, purses, phones, keys, cash, vehicles, or any other items brought onto the premises.
Member assumes all risk of loss, theft, or damage to personal property, whether occurring in workout areas, locker rooms, tanning rooms, sauna areas, restrooms, parking areas, or elsewhere on the property. The use of lockers, cubbies, or storage areas is solely at Member’s own risk and does not create a bailment or duty of care.
Member hereby releases Iron House TC LLC from any and all claims arising out of or related to theft, loss, or damage to personal property, whether caused by other members, guests, third parties, or otherwise, to the fullest extent permitted by Michigan law.
11. VIDEO SURVEILLANCE (CCTV) DISCLOSURE
Member acknowledges and understands that **video surveillance cameras (CCTV)** may be in use on the premises of Iron House TC LLC for purposes including, but not limited to, safety, security, theft deterrence, and operational oversight.
Member understands and agrees that:
* Cameras may be located in common areas such as workout floors, entrances, exits, hallways, and parking areas
* Cameras are **not intentionally placed in private areas** such as restrooms, showers, or changing areas
* Video footage may be recorded, stored, reviewed, and used by Iron House TC LLC for legitimate business, safety, or legal purposes, including investigation of incidents or compliance with law enforcement requests
By entering the premises, Member **consents to video recording** as permitted by applicable Michigan law and releases Iron House TC LLC from any claims related to the lawful use of video surveillance.
12. GOVERNING LAW AND SEVERABILITY
This Agreement shall be governed by and interpreted in accordance with the laws of the **State of Michigan**. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties regarding liability and risk assumption and supersedes any prior agreements or representations. Member acknowledges that they have read, understood, and voluntarily signed this Agreement.
MEMBER ACKNOWLEDGMENT AND SIGNATURE
By signing, Member acknowledges that this is a **legal document** and that they are giving up substantial legal rights, including the right to sue.
Members must conduct themselves in a respectful and non-disruptive manner at all times. Harassment, intimidation, threatening behavior, or interference with other members or staff will not be tolerated.
Members must maintain reasonable personal hygiene and wear appropriate workout attire and footwear at all times. Strong or persistent odors, unsanitary conditions, or inappropriate clothing that interfere with the comfort, safety, or enjoyment of others may result in removal from the facility or termination of membership.
Members agree to use all equipment properly and only as intended. Members must return weight plates, attachments, and accessories to their designated locations to the best of their ability. Members must comply with all posted rules and staff instructions. Unsafe, reckless, or improper use of equipment is strictly prohibited.
Members must wipe down equipment after use and dispose of trash properly. Deliberate unsanitary behavior may result in immediate removal.
Personal training, coaching, or solicitation of services is prohibited unless authorized by IRON HOUSE TC LLC.
The use, possession, or influence of illegal drugs, alcohol, or prohibited substances is strictly forbidden on the premises.
Weapons of any kind, including firearms, are prohibited on the premises unless expressly permitted by law and by gym policy.
IRON HOUSE TC LLC reserves the right, in its sole and reasonable discretion, to refuse service, deny access, suspend, or terminate any membership, without refund, for violations of the foregoing gym rules.
Members acknowledge that access to the facility is a privilege, not a right, and agree that enforcement of gym rules may occur at any time, with or without prior warning, as deemed appropriate by management.
All rules and enforcement actions shall be applied in a neutral, nondiscriminatory manner and in accordance with applicable federal, state, and local laws.
