30 Days Notice:
At Steelworx Gym we do not believe in hidden fees or complicated contracts. We do ask, however, that all members observe our 30 Days Notice Policy. In order to cancel, remove a member from, or freeze an account, an official Cancelation or Freeze Receipt must be signed and dated on or before the first (1st) day of the previous calendar month. For example, in order to cancel/remove/freeze and not be charged on January 1st, the proper paperwork must be completed and signed no later than December 1st, the month prior. A last draft will be required on all cancellations, removals and freezes completed after the first (1st), making the membership valid until the end of the following month. The last draft of the account will be collected at the time of cancellation. A cancellation will not be valid until the last draft and any outstanding balances have been paid in full.
Cancel While Frozen:
If your account is frozen and you wish to cancel it, we may be able to accommodate your request to cancel before your account unfreezes, so long as your cancelation receipt is signed and dated at least seven (7) calendar days before the 1st of the month, when the draft is set to take place. If your cancelation request is not completed 7 days prior to the unfreezing your account, you may be charged a final draft, per the 30 Day Notice of Cancelation Policy.

Member Assumption of Risk and Release:
STEELWORX GYM AND TRAINING CENTER, LLC ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM I, , HEREBY ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATING IN ANY AND ALL ACTIVITIES AT OR AROUND THE STEELWORX GYM AND TRAINING CENTER FACILITY, including by way of example and without limitation, any risks that may arise from negligence or carelessness on the part of myself, and/or the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activities at The SteelWorx Gym and Training Center facility, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation on activities at SteelWorx Gym and Training Center. I certify that prior to utilizing any kind of equipment at SteelWorx Gym and Training Center, I will read the instructions on how to use such equipment, and I will follow the instructions as directed for each and every piece of equipment. I certify that in the event there are no instructions on a piece of equipment, I will bring it to the attention of SteelWorx Gym and Training Center immediately, and will seek guidance on how to utilize the equipment prior to engaging in any use. I acknowledge that this Waiver and Release of Liability Form will be used by SteelWorx Gym and Training Center and its owner(s), and that it will govern my actions and responsibilities for partaking in any and all activities at SteelWorx Gym and Training Center. In consideration of my application and permitting me to participate in activities at SteelWorx Gym and Training Center, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND FOREVER DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from SteelWorx Gym and Training Center, THE FOLLOWING ENTITIES OR PERSONS: SteelWorx Gym and Training Center, its owner(s), employees, volunteers, representatives, and agents; (B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in SteelWorx Gym and Training Center, whether caused by the negligence of SteelWorx Gym and Training Center, its owner(s), or myself. I acknowledge, understand and agree that SteelWorx Gym and Training Center, its owners, employees, volunteers, representatives, and agents; are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf. I acknowledge, understand and agree that partaking in activities at SteelWorx Gym and Training Center may involve a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by the facility, condition of participants, equipment, lack of hydration, and actions of other people including, but not limited to, owner(s), members, trainers, participants, volunteers, or agents. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness while at SteelWorx Gym and Training Center, by a medical professional, and agree to pay for such services should I not be conscious and/or able to approve such treatment at the time of injury. I acknowledge, understand and agree that no Personal Trainer at SteelWorx Gym and Training Center is an employee of SteelWorx Gym and Training Center, and that prior to commencing any personal training session with a personal trainer at SteelWorx Gym and Training Center, I confirmed with the Personal Trainer that he/she carried insurance to cover him and myself should I become injured during a training session. I understand that while participating in activities at SteelWorx Gym and Training Center, I may be photographed and/or recorded. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by SteelWorx Gym and Training Center. This Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. Member Date

EFT Members: There will be a mandatory, annual $49 Maintenance Fee charged to your account approximately 2 billing cycles after your initial sign-up date.

Policy Statement
1. NOTICE TO PURCHASER: DO NOT SIGN THIS CONTRACT UNTIL YOU READ IT OR IF IT CONTAINS BLANK SPACES.
2. IF YOU DECIDE YOU DO NOT WISH TO REMAIN A MEMBER OF THIS HEALTH SPA, YOU MAY CANCEL THIS CONTRACT BY MAILING TO THE HEALTH SPA BY MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DAY YOU SIGN THIS CONTRACT A NOTICE STATING YOUR DESIRE TO CANCEL THIS CONTRACT. THE WRITTEN NOTICE MUST BE MAILED BY CERTIFIED MAIL TO THE FOLLOWING ADDRESS: STEELWORX GYM 310 GENESIS WEBSTER, TX 77598.
4. IF YOU DIE OR BECOME TOTALLY AND PERMANENTLY DISABLED AFTER THE DATE THIS CONTRACT TAKES EFFECT, YOU OR YOUR ESTATE MAY CANCEL THIS CONTRACT AND RECEIVE A PARTIAL REFUND OF YOUR UNUSED MEMBERSHIP FEE BY MAILING A NOTICE TO THE HEALTH SPA STATING YOUR DESIRE TO CANCEL THIS CONTRACT. THE HEALTH SPA MAY REQUIRE PROOF OF DISABILITY OR DEATH. THE WRITTEN NOTICE MUST BE MAILED BY CERTIFIED MAIL TO THE FOLLOWING ADDRESS: STEELWORX GYM 310 GENESIS WEBSTER, TX 77598.
5. FREEZE OF MEMBERSHIP PAYMENTS This membership may have the payments suspended ('frozen') at any time with written notice at the Front Desk for up to 6 months. A Freeze will guarantee your monthly rate when payments resume in the future.
6. RULES AND REGULATIONS You agree to be bound by the club`s rules and regulations regarding use of facilities and conduct. These rules may be posted from time to time in the club. The current rules and regulations include (but not limited) to the following:
A. All members are required to sign in (card swipe) at the Front Desk when they enter the club.
B. Lost and Stolen Property: You agree that neither the club nor its agents and employees shall be responsible for lost or stolen articles of clothing or personal property. You acknowledge and agree that valuable property shall not be brought into the club, and by bringing such personal property in to the club, you assume all risks of loss or theft and you hereby waive all claims and release the club, its agents and employees, from all liability in the event of loss or theft notwithstanding that such loss or theft may have resulted from the negligence or gross negligence of the club.
C. All clothing worn in the club should be clean, neat, and free of offensive language or signage. Shoes must be worn at all times on the floor. Sandals are not permitted.
D. Lockers in each Locker-room are for day use only and any locks left on at the end of each day may be removed and all contents removed from the locker.
E. Club management reserves the right to revoke any membership of anyone who disrupts the family atmosphere of this club. Loud profane language, harassment of other members, and solicitation are typical behaviors that may result in the termination of your membership. Club Management reserves the right to enforce this rule to ensure that all of our members are comfortable in attending this club.
7. ACCIDENTS YOU AGREE THAT YOUR USE OF THE CLUB'S EQUIPMENT AND FACILITIES WILL BE AT YOUR SOLE RISK, AND SO IS ALL OF YOUR ACTIVITY OF THE SPA. YOU FURTHER AGREE THAT SPA WILL NOT BE RESPONSIBLE FOR ANY INJURIES OR DAMAGES TO YOU, YOUR GUESTS, OR YOUR PROPERTY BECAUSE OF THE USE OF THE CLUB AND ITS SERVICES.
8. ENTIRE AGREEMENT You agree that this contract is the entire agreement between you and the club. You agree that it is the only agreement and you acknowledge that the only statements you have relied upon in signing the contract are the statements contained in this agreement. This agreement can only be changed in a written document signed by you and the club. The only exception is the club's Rules and Regulations, which the club can change at its sole discretion. If any part of this agreement is unenforceable, this will not make any other part of it unenforceable.
9. MEMBER WAIVER AND RELEASE As a member voluntarily participating in a program of strenuous physical activity, including, but not limited to aerobic dance, weight training, and the use of various aerobic/conditioning machinery offered by Steelworx Gym, I hereby AFFIRM that I am in good physical condition and do not suffer from any disability that would prevent or limit my voluntary participation in the above referenced exercise program. In consideration of my participation in Steelworx Gym exercise programs and I hereby RELEASE Steelworx Gym, its employees, agents, directors, and owners from any and all claims, demands, and causes of action arising from my participation in the exercise program. I FULLY understand that I may injure myself as a result of my participation in Steelworx Gyms exercise programs and I hereby RELEASE Steelworx Gyms, its employees, agents, directors, and owners, from any liability, now or in the future, including, but not limited to heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury have or caused, occurring during or after my voluntary participation in the exercise program.
