All memberships require a card on file for monthly billing. Members can avoid a 4.5% convenience fee applied to debit and credit card transactions by paying monthly bills with cash before the billing date or by providing a bank account for automatic withdrawals.
Members agree to promptly pay all the monthly charges and dues after being accepted for membership. The first month`s dues will be due upon signing the contract. Dues will be charged on the same day as sign-up each month. Dues are payable with or without a statement. If delinquent more than 60 days, The Facility may cancel Member’s membership and begin collection proceedings to satisfy Member’s total membership obligations under this Agreement. A 30-day notice will be given whenever there will be an increase in dues to maintain the quality of The Facility, if so desired, Member may terminate his or her membership during such 30-day period.
After Member has completed the term of his or her membership (as set forth on the application page), Member’s membership will automatically renew for another period of equal length unless Member provides The Shapenet Financial Services written notice of cancellation at least 30 days prior to the renewal date.
It is agreed that all use of The Facility will be undertaken by the Member at his or her own risk. The Facility expressly disclaims all warranties, express or implied. It is further agreed that The Facility, its owners, members, managers, employees, representatives, and agents will not be liable for any damages - direct, consequential, exemplary, special, punitive, or otherwise - arising from personal injuries sustained by Member on or about The Facility’s premises or as a result of Member’s use of the equipment therein. A member’s sole and exclusive remedy for breach by The Facility will be the return of any pre-paid membership dues. Member accepts full responsibility of any injuries or damages that may occur to the Member on or about The Facility’s premises and further agrees that The Facility will not be liable for any damage, loss, or the of Member’s personal property. Member does hereby fully and forever release and discharge The Facility, its owners, members, managers, employees, representatives, and agents from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether they be known or unknown, anticipated, or unanticipated, resulting from or arising out of Member’s use or intended use of The Facility and equipment therein. The following below is a Release of Liability Waiver that I agree to read before signing. I am physically sound and have medical approval to proceed with a normal routine of exercise, and all exercise shall be undertaken by me at my sole risk. I am in good health and have no physical condition that would be aggravated by involvement in cardiovascular exercise, weightlifting, weight training, and/or bodybuilding, nor do I have any physical limitations that would preclude said involvement.
HaloTherapy Center, LLC provides Salt Athletics to World Gym Pensacola. Salt Athletics involves intake of ionized water, moringa tea, and environments that deliver halo therapy (dry salt therapy), red light therapy, oxygen-rich environments, ozone generators and physical exertion. Check with your physician or medical advisor before engaging in any of these therapies to ensure you are healthy and physically cleared to do so.
I am forewarned that World Gym Fitness Centers will not in any event provide medical and/or hospitalization insurance for my benefit, in the event of any injury to my person occurring either as a result of my being on any portion of the premises of the World Gym Fitness Centers. I will save harmless and keep indemnified World Gym Fitness Centers and their respective trustees, beneficiaries, staff, officers, directors, shareholders, and agents from and against any and all actions, claims, costs, expenses, or demands, in respect of such injury or injuries, including death, howsoever caused, arising out of or in connection with my use of the World Gym Fitness Centers facilities or my being on and portion of said premises and notwithstanding that the same may have contributed to or may be caused by the negligence or World Gym Fitness Centers, and its respective trustees, beneficiaries, staff, officers, directors, shareholders, and agents.
I will abide by each and every of the World Gym Fitness Centers rules and regulations, and I further agree that if I fail to comply, that World Gym Fitness Centers and its staff shall have the right at any time, in their sole and absolute direction, to cancel any membership, in such event I shall be entitled to a refund for the period of time remaining on my membership.
I am hereby informed of my option to sign a new release on each date that I use World Gym Fitness Centers facilities. However, I elect to forego that option, and I therefore acknowledge and intend that this release and waiver of rights shall be effective not only on the date hereof, but also on all occasions subsequent hereto when I use the World Gym Fitness Centers facilities.
The semi-annual fee applies to all monthly memberships. The semi-annual fee is $29.95 applied in the months of March and September. Both semiannual fees are due on each term year of each contract and renewal year.
Please give 30 days’ written notice if you would like to change your method of payment. This authorization for automatic charge remains in effect until you cancel the Membership in writing.
THE UNDERSIGNED (“MEMBER”) HEREBY APPLIES FOR MEMBERSHIP AT Sunshack II LLC dba World Gym Pensacola & World Gym Cantonment, (HEREAFTER REFERRED TO AS “THE FACILITY”) AND IF ACCEPTED, AGREES TO THE FOLLOWING TERMS AND CONDITIONS:

Cancellation Procedure: I agree not to request a refund of my membership dues or not to request a chargeback to my credit card or bank account of my membership dues paid unless I have a signed required cancellation form dated prior to the date of my request for a refund or my request for my chargeback to my credit card or bank account returned. Any change to the EFT information, including ACH information, Debit/Credit Card information or payment dates, must be provided in writing prior to the next scheduled payment date. Should you need to cancel any recurring services or recurring auto-drafts, you will need to submit your written request to World Gym. No verbal request for cancellation of either services or auto draft will be honored as it must be a written request. I have read, understand, and agree that I am legally bound by the requirements of the Semi- Annual Fee and Cancellation Procedures explained in this World Gym facility document.
Cancellations/Assignment: Member may cancel this Agreement with a penalty payment of $200- or four-months’ dues, whichever is greater. Member’s membership can be cancelled without penalty if Member moves more than 20 miles out of the area. Failure to use the membership does not relieve Member of liability for payment. Member’s membership is non-transferable and nonrefundable, and may not be assigned or cancelled by Member, except as provided in this Agreement. The Facility may transfer or assign this Agreement without Member’s consent.
Refunds: All memberships are non-refundable other than the approved three-day cancellation (see buyers rights to cancel).
Buyers Rights to Cancellation: Members are entitled to the penalty-free cancellation of this contract within 3 days, exclusive of holidays and weekends, of its making, upon the mailing or delivery of written cancellation notice to the health studio, and refund upon such notice of all moneys paid under the contract, except that the health studio may retain an amount computed by dividing the number of occasions the health studio services are to be rendered from the total contract price and multiplying the result by the number of occasions that health studio services have been rendered. A refund shall be issued within 30 days after receipt of the notice of cancellation. You have the right to cancel this agreement, if we go out of business or move our facilities more than five driving miles from the business location designated and World Gym Pensacola fails to provide, within 30 days, a facility of equal quality located within 5 driving miles from business location designated in such contract at no additional cost to buyer. Members should be advised that any notice of his/her intent to cancel should be given in writing by filling out the health studio cancellation form. Such notice should be sent or delivered to World Gym Pensacola, 7166 North 9th Avenue, Pensacola, Florida 32504. Such a notice of cancellation shall also terminate automatically the consumer’s obligation to any entity to whom the health studio has subrogated or assigned the consumer’s contract. If the health studio wishes to enforce such contract after receipt of such showing, it may request the department to determine the sufficiency of the showing. Any such refund shall be computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. Our business location shall not be deemed out of business when temporarily closed for repair and renovation of the premises: (a) upon sale, for not more than 14 consecutive days; or (b) during ownership for not more than 2 periods of 7 consecutive days in a calendar year. In the event we go out of business, you should contact the department of agricultural and consumer services within 60 days from that date of closing to address any unresolved conflicts. In addition, this membership may be cancelled if you expire or become physically unable to make use of a substantial portion of the services offered by World Gym. World Gym reserves the right to require member or member’s estate to provide proof of disability or death. A physical disability sufficient to warrant cancellation of this agreement shall be established if the member furnishes World Gym with certification of such disability by a physician licensed under chapter 458, 459, 460, or chapter 461 provided the diagnoses or treatment is within the physician’s scope of practice. The refund amount will be determined by pro-rating the initial membership price by the number of weeks remaining on the membership agreement. World gym reserves the right to pay this amount in full or by payment. A refund shall be issued within 30 days.
Authorization to Collect: I authorize Sunshack II LLC dba World Gym Pensacola & World Gym Cantonment to collect any dues and incidental charges on my membership account via my Credit Card or checking account. Please give 30days written notice if you would like to change your method of payment. This authorization for automatic charge remains in effect un l you cancel the Membership in writing.

Member ID 24/7 key fobs are required to be scanned at the front door at the start of each visit. Replacement 24/7 fobs are $40.
A 1.5% monthly finance charge (18% annually) is added to past due accounts. The minimum finance charge is $2. There will be a $20 fee applied a er dues are 5 days late.
There will be a $40 NSF fee on any check returned to The Facility.
Rules and Regulations: Members agree to abide by the rules and regulations promulgated by The Facility. Members agree that viola on of such rules and regulations may cause Member’s membership to be immediately terminated in the sole discretion of The Facility. I understand the facility staff may ask to see a photo identification to confirm identity and may deny entry to anyone failing to do so. No person other than a certified World Gym trainer may conduct any training of any World Gym member or guest.
No Waiver: The Facility does not waive its right to have future payments made when due if The Facility accepts a late or partial payment or delays in the enforcement of its rights on any occasion.
Default: If Member in any way defaults in the performance of his or her obligations under this Agreement, then The Facility may immediately demand and be entitled to payment of all unpaid installments. If Member’s failure to pay any one or more of the payments due under this Agreement results in The Facility retaining an attorney for collection of the payments due hereunder, Member will be responsible for the payment of court costs and reasonable attorney fees.
Member’s Physical Condition: Member represents and warrants that Member is in good physical condition and that he or she has no disability, impairment or ailment preventing him or her from engaging in active or passive exercise or that may be detrimental or inimical to his or her health, safety, comfort, or physical condition if he or she does so engage or participate.
Unavailability of Facility: The Facility reserves the right, and without prior notice to Member, to temporarily close The Facility or a portion thereof, for remodeling, improvements, or repairs. The Facility reserves the right to permanently close The Facility, and in such an event, the Member’s membership will be terminated.
Use of Facility: Members agree to be subject to the control and guidance of all The Facility staff while on The Facility’s premises and will follow the instructions of the staff. Members agree to conduct themselves in a quiet, well-mannered fashion while on The Facility’s premises. In the event of an accident, Member agrees to be examined at Member’s sole expense by a licensed physician and Member agrees to complete and return The Facility’s accident and injury report form to The Facility.
Indemnification: Member agrees to indemnify and hold The Facility harmless for any and all liability, loss, claims, expenses (including attorney’s fees), and other damages (collectively, “Damages”) resulting from a breach of this Agreement or caused by member in connection with his or her use of The Facility or the equipment therein, including property damage and personal injury or death.

ALLOWING UNAUTHORIZED PERSONS INTO THE WORLD GYM FACILITY, AUTHORIZES THE WORLD GYM FACILITY TO APPLY FOR AUTOMATIC ACH CREDITS OR CREDIT CARD ENTRIES TO MY BILLING INFORMATION FOR THE APPR0PRIATE GUEST FEES AT $30 PER VISIT AND I AGREE THAT MY MEMBERSHIP MAY BE TERMINATED IMMEDIATELY THEREAFTER.
Security: The World Gym facility is monitored and recorded VIA internet cameras 24/7. The facility is well lit in the evening hours and monitored by an alarm company. As a 24/7 key fob member, you agree that your key fob is only for your sole use. Each person who enters the facility must use their own key fob. Do not open the door for members who do not have a key fob. Or their key fob is not working. At each facility, there is an emergency 911 phone that dials directly to 911. There is also a defibrillator available for use at each facility.
Key Fobs: Each member must use their own key fob and enter the entrance door one member per me. The replacement key fob is $40. Malfunctioned fobs are replaced at no charge.
Gym Etiquette: World Gym encourages serious lifters. Our heritage includes most of the great legendary bodybuilders and lifters. Former owner, Joe Gold had rules that his members followed that World Gym follows today - Shirt and shoes must be worn inside the gym but outside lifters can go down to the swimsuit. If you drop weight, the weight is too heavy and throwing weights is not permitted. Rack your weights for the next lifter, outside equipment clean. Clean towels that have been disinfected and washed with hospital grade lucasol are provided. Spray bottles with appropriate amount of lucasol solution are provided. Members must have a spray bottle and clean towel to spray equipment after each use. This solution is not harmful to the skin. A clean cart is at the entrance with the clean towels and spray bottles. A hamper and another cart are at the exit for dirty towels and bottles. DO NOT TAKE THE TOWELS. The facility is sanitized with bleach and cleaned each day.
Parking: A World Gym parking pass is required for all vehicles in our parking lots.
General: The provisions of this Agreement are severable. If any provision of this Agreement is declared to be void, not valid or unenforceable, it is the intention of the parties to this Agreement that the remainder of this Agreement remain valid and enforceable. This Agreement and the rules and regulations referenced herein represent the entire agreement between The Facility and Member. The Facility will have all rights and remedies provided by law and the remedies provided in this Agreement are cumulative. The laws of the State of govern this Agreement. Members must be 18 years old or older. A photocopy of the Member’s driver’s license is required to complete this Application/Agreement.
Membership Freeze Policy: World Gym allows their members to freeze their membership for up to three (3) months at a time, with the freeze subject to manager approval. Each member may freeze their account a maximum of two (2) separate times during the lifetime of their membership. A freeze fee equal to 50% of the member’s current monthly rate is required upfront at the start of the freeze period.This fee applies regardless of how much time remains in the member’s current billing cycle.
